History never forgives: Justice Mansoor Ali Shah

Supreme Court senior judge Syed Mansoor Ali Shah has refused to sit at special or larger benches formed by the committee after Supreme Court Practice and Procedure Act 2023 amendments passed through a Presidential Ordinance last month.

In a letter addressed to the committee, led by Chief Justice Qazi Faez Isa, Justice Shah expressed his concerns about the formation of benches, writing: “I will not participate in special benches formed by the new committee and will only attend sittings of regular benches to hear the cases of ordinary litigants in the larger public interest.”

“We often forget, when in power, that people of this country are watching our actions and that history never forgives,” he remarked.

He quoted Sir Thomas More from A Man for All Seasons: “I think that when statesmen forsake their own private conscience for the sake of their public duties, they lead their country by a short route to chaos.”

There has been significant controversy over the appointment of the next CJP after the coalition government successfully passed the 26th amendment, which gave more power to the Special Parliamentary Committee to appoint the next Chief Justice.

Before the amendments, Justice Shah, being the senior judge, would have become the next CJP after Justice Isa. The committee, however, nominated Justice Yahya Afridi as the next CJP, bypassing the other two senior judges, Justice Mansoor Ali Shah and Justice Munib Akhtar.

Islamabad Court orders Adiala authorities to present Imran Khan in court today

The Islamabad High Court (IHC) has directed the Adiala Jail Rawalpindi authorities to present the founder of Pakistan Tehreek-e-Insaf (PTI), Imran Khan, before the court at 3 PM today.

“Bring the PTI founder; he will have a meeting with his lawyers,” IHC stated during the hearing of a contempt of court case against the Adiala Jail Rawalpindi Superindentent for not allowing lawyers to meet Khan in jail.

Justice Sardar Ejaz Ishaq Khan directed the superintendent to record reasons for every time he failed to ensure Imran Khan’s presence before the court.

“The court does not accept the security threats […] the lawyers were not allowed to meet. This is contempt of the court,” Justice Sardar Ejaz Ishaq remarked.

Citing the imposition of a ban on lawyers meeting with Khan, the State Council informed the court that the Punjab government had imposed the ban on meeting in Adiala jail amidst security concerns.

“Is there a ban on lawyers meeting him? If the Punjab government has prohibited the meeting of the lawyers, it would have committed contempt of court; whoever issued this notification has also committed contempt of court,” the court responded to the state council’s argument on security concerns, and directed the authorities to present the PTI founder in court.

However, later in the day, it was reported that Adiala Jail authorities had arranged for a meeting between Imran Khan and lawyers Salman Akram Raja, Faisal Fareed Chaudhary and Shoaib Shaheen.

Security concerns were cited by jail authorities for being unable to present the PTI founder in court instead. Imran’s lawyers have also been informed about the development, reports said.

  • Bushra Bibi will be free, and Khan will be allowed meetings in jail: Faisal Vawda

Bushra Bibi will be free, and Khan will be allowed meetings in jail: Faisal Vawda

Senator Faisal Vawda, known for his tall claims, has alleged on a political talk show at ARY News that Bushra Bibi, former Prime Minister’s wife, will be released from jail on the 26th of this month while meetings with Imran Khan in Adiala Jail will continue as usual.

“She will be completely free, and no new cases will be made against her once her bail is granted. Regular meetings with Imran Khan will be resumed,” claimed the senator.

On October 23, Bushra Bibi was granted bail in the new Toshakhana Case by the Islamabad High Court; however, despite PTI’s utmost attempts, she has not been released from prison.

According to PTI’s legal team, the judges suddenly became absent, and the entire judicial complex was empty. When the lawyers approached the third and fourth judges on duty, they refused to sign the release papers.

Treasury members in the Khyber Pakhtunkhwa Assembly on Wednesday condemned the non-release of Bushra Bibi despite her bail.

Vawda also alleged, “The entire leadership of PTI is compromised, and Khan in jail is actually a good thing for them.”

Tech-savvy robbers loot Lahore home after jamming signals

A gang of technologically advanced robbers looted gold and cash worth over Rs15 million from a house in Defence Housing Authority (DHA) Lahore after they successfully jammed Bluetooth and wireless signals for cell phones, GPS and Wi-Fi by using special blocking devices.

The gang of five escaped via the motorway and then took an exit from a Faisalabad interchange while special teams were waiting to catch them at the exit points in Islamabad and Sargodha.

The police from various cities of Punjab, however, failed to trace and arrest the criminals despite multiple efforts.

    The incident

Reports suggest that five masked men brought a special device to disrupt the operations of all mobile phone services in the vicinity of around 100 meters, which left the family without any option of contacting the police or any other for help.

The house is located in DHA Phase 4, and it is owned by a retired Superintendent of Police (SP), Rana Azeem, who rented it out to a tenet family of Mubashar Ahmed.

Ahmed told the police that five armed men with masks on their faces forcefully entered his residence on Tuesday midnight.

The dacoits held the family hostage in a room and collected 35 tola gold, including bangles and locket sets worth over Rs 8.75 million, 12 branded watches valued over Rs 1.3 million, a cash of Rs3.5 million, along with other valuables. In total, they took away Rs15.5 million worth of valuables.

Three of them were carrying rifles, and two others were with pistols.

Ahmed claimed that one of the robbers seemed to be between 65-70 years and one 50 years of age.

The initial investigation revealed that this was the fourth house robbery by the same gang during 20 days in Defence Block A and Block C.

They used a Honda Civic car in all the instances with fake registration number plates.

After robbing the house on Tuesday, however, the robbers fled via motorway.

    Statement of the police

Deputy Inspector General of Police (DIG) Imran Kishwar of Organised Crime Unit (OCU) Lahore stated that the robbers had reached near Sherakot by the time the family alerted them, after which an encounter took place with the SHO concerned and his team, but the “robbers opened fire, hit the police barriers and managed to reach the motorway.”

The police had installed pickets at the exit points of Islamabad, Sargodha and some other districts, but the tech-savvy robbers took a surprise exit from Faisalabad and disappeared.

“We are on a hot pursuit of the hardened criminals and will round them up soon,” DIG Kishwar asserted.

However, the DIG stated that the Punjab police had contacted the Dera Ismail Khan police as reports suggested that the suspects might go underground there.

  • Here’s why govt didn’t want Mansoor Ali Shah as next chief justice

Here’s why govt didn’t want Mansoor Ali Shah as next chief justice

In an interesting development, prominent journalist Fakhar Durrani revealed why the government didn’t want Justice Mansoor Ali Shah as the next chief justice of Pakistan.

Speaking on ‘Fact Check Pakistan,’ he disclosed that things started turning against Justice Shah after he announced the reserved seats verdict on 12 July.

On July 12, the Supreme Court of Pakistan declared Pakistan Tehreek-e-Insaf eligible for reserved seats of Women and non-muslims.

Chaired by Chief Justice Pakistan Qazi Faez Isa, the 13-member larger bench was hearing the appeal filed by the Sunni Ittehad Council party against the Peshawar High Court’s (PHCs) recent reserved seat verdict.

Justice Mansoor Ali Shah, a second senior judge in the top court (counting Qazi Faez Isa as the first), had announced the majority eight-member verdict on reserved seats and ordered the Election Commission of Pakistan (ECP) for the allotment of Women and non-muslim seats to PTI.

The other eight member judges, along with Justice Mansoor Ali Shah, were Justice Shahid Waheed, Justice Ayesha Malik, Justice Irfan Saadat, Justice Athar Minallah, Justice Munib Akhtar, Justice Hasan Azhar Rizvi, and Justice Muhammad.

Fakhar Durrani stated that following the verdict on reserved seats, Justice Shah reportedly sent a WhatsApp message to one of his wives, which the country’s agencies intercepted and informed the government about it.

“Main ne tumhary leader kay liye ye kar diya hai,” Fakhar Durrani quotes the message.

He also said that Justice Mansoor Ali Shah’s further conversation was collected, which was reportedly biased towards Pakistan Tehreek-e-Insaf (PTI).

Based on Shah’s tilt toward PTI and the fear that Shah Could give the government a tough time, the ruling government decided to pass the 26th Constitutional Amendment before October 25, the date when Chief Justice of Pakistan (CJP) Qazi Faez Isa would retire as CJP, Durrani added.

Durrani also claimed that Chairman Pakistan Peoples Party (PPP) Bilawal Bhutto Zardari, while giving the reason for the judiciary’s past controversial verdict and citing the top court verdict on the disqualification of former prime minister Nawaz Sharif, convinced Jamiat Ulema-e-Islam Fazl (JUI-F)

“There should be a process of accountability for judges, and parliament should have a role in the appointment of judges,” Bhutto had said.

Clarifying why Justice Mansoor Ali Shah’s message was not made public, the journalist claimed that the message was not public by the government amid fear of being disgraced internationally.

Justice Mansoor Ali Shah has not responded to this latest development that journalist Fakhar Durrani claimed.
