    Arif Alvi dismisses Secretary to President as bills mystery deepens

    Hours after the President said that he does not need Waqar Ahmed’s services, the Secretary has said in a statement on Monday that Dr. Arif Alvi did not sign the Official Secrets (Amendment) Bill, 2023, or the Pakistan Army (Amendment) Bill, 2023, nor did he make a written decision to send them back to parliament for further consideration.

    On Monday, the official X (formerly Twitter) account of @PresOfPakistan stated: “In view of the definite statement of yesterday, President’s Secretariat has written a letter to Principal Secretary to Prime Minister that the services of Mr. Waqar Ahmed, Secretary to President, are no more required and are surrendered to the Establishment Division, immediately”.

    President Arif Alvi caused a sensation on Sunday when he said in a tweet from his personal account that he did not sign the official secrets (Amendment) Bill, 2023, or the Pakistan Army (Amendment) Bill, 2023, as he does not agree with the laws. He said that despite his orders to return the bills to parliament, his staff disobeyed him.
    “I confirmed from them many times that whether they have been returned & was assured that they were,” Alvi wrote about the bills in a tweet, adding that he just found out that his staff “undermined my will and command”.
    He also asked for forgiveness from those who are affected by the bills.

    The tweets came about after news broke that he had signed the Official Secrets (Amendment) Bill, 2023, and the Army Act (Amendment) Bill, 2023. Now both bills are part of the law.
    On the other hand, former Senate Chairman Raza Rabbani has said that “the tweet of President Arif Alvi was inappropriate”.
    Raza Rabbani pointed out that if an inquiry is initiated, the president will have to appear before a committee of the upper house since he is a part of the parliament under Article 50 of the Constitution.
    “As per Article 75 of the Constitution, when a bill is sent for assent, the president has two options: either give assent, or refer the matter to the parliament with specific observations. Article 75 does not provide for any third option,” he stressed.
    The ministry has said neither of the requirements was fulfilled. Instead, the president purposely delayed the assent, it added. Returning the bills without any observations or assent is not provided for in the Constitution, the spokesperson said, adding that such a course of action is against the letter and spirit of the Constitution.
    “If the president had any observations, he could have returned the bills with his observations like he did in the recent and distant past. He could have also issued a press release to that effect,” the law ministry said.

    Lawyer and activist Imaan Zainab Mazari-Hazir and Former Member of the National Assembly (MNA) Ali Wazir were produced before Anti Terrorism Court (ATC) judge Abul Hasnat Zulqarnain on Monday. Imaan’s legal team argued that “Police have not yet found anything,” and that “officials had also not investigated anything related to Imaan”.

    It was also mentioned that Imaan fainted at the police station and was unable to meet her mother. “Imaan Mazari wants accountability of institutions for which she is being called a terrorist,”

    Similarly, Ali Wazir affirmed that “nothing wrong” has been done and that they had insisted the interim government let them gather in islamabad. “We wanted our voices to be heard in Islamabad”, added Wazir.

    The court reversed its verdict and granted a three-day physical remand of the two.

    On Sunday, 20 August, human rights lawyer Imaan Zainab Mazari-Hazir and former lawmaker Ali Wazir were arrested by “unidentified persons”. While the reasons for the arrests have not been given by the police, Islamabad Capital Police stated, “No one is authorised to give a statement from a police station.”

    Imaan Mazari’s mother, Shireen Mazari, said while talking to the media that Imaan was dragged out and taken away. The policewomen also dragged Shireen Mazari herself but the officials let her go since they were only there to arrest Imaan Mazari.

    About twenty men made their way to Imaan’s bedroom and confiscated her laptop and phone. They did not let her change her clothes either and dragged her out where another 20 officials were standing outside. No men, however, wore police uniforms.

    The cases so far

    On Friday, 18 August, approximately 300 people attended the Pashtun Tahafuz Movement protest in Islamabad. The speakers included Ali Wazir and Imaan Mazari. The focus of the speeches was condemnation of discrimination against the Pashtuns and called for the return of missing persons.

    Imaan Mazari and Ali Wazir were presented before district and sessions court where Judicial Magistrate Ihtasham Alam Khan heard two of their cases on Sunday.

    In the first, terrorism case, the investigating officer (IO) requested for a 10-day physical remand. The judge, however, has ordered for the two to be presented in an anti-terrorism court. Imaan was to be kept in a women police station till Monday.

    In the other case, the IO requested a five-day physical remand for Mazari and Wazir but the judge said the court could not grant Imaan’s physical remand.

    She has been sent on 14-day judicial remand with orders to be produced on September 2 whereas Wazir has been granted two-day physical remand after pre and post-medical examination.

    Two first information reports (FIR) have been registered against Wazir and Imaan.

    The first FIR was registered on the complaint of Tarnol Station House Officer (SHO) Miam Mohammad Imran who was present at Tarnol Phatak chowk to ensure peace during a rally led by Pashtun Tahafuz Movement (PTM). According to the complainant, the rallly devaited from the allocated area violating no-objection certificate

    The SHO has claimed that the participants of about 700-800 were armed with sticks who attacked the police, official vehicles, and shut down shops when asked to restore access to GT road that they had blocked.

    The second FIR was registered under the complaint of Inspector Mohammad Ashraf who was present when about 950 PTM supporters blocked GT road. He said that people including Manzoor Pashteen and Iman Mazari spoke against the state, inciting hatred and revolt.

    A PTM spokesperson told AFP that many more members have also been detained since Friday protests.

    Pakistan Bar Council has held a meeting and strongly condemned the decision of the Election Commission of Pakistan (ECP) to delay elections beyond the constitutional limit of 90 days, citing delimitation.

    According to sources, the members discussed the situation regarding the delay in elections and decided to launch a “lawyers’ movement in case elections are not held within 90 days.”

    They reiterated that Article 224 of the constitution of Pakistan binds ECP to conduct the general election within 90 days after the dissolution of assemblies.

    The Vice Chairman and Chairman of the Executive Committee said, “It is the duty of the commission to conduct free, fair and transparent elections within stipulated period as mandated by the constitution.”

    Earlier this week, The Supreme Court Bar Association challenged the decision to hold the upcoming general elections based on the fresh census, seeking suspension of the decision.

    It further demanded that the Supreme Court order the ECP to hold general elections immediately in the country.
    The SCBA says elections on the new census is an attempt to unconstitutionally delay the exercise. In the petition, the federation, the Council of Common Interests, the four provinces and the Election Commission of Pakistan have been made parties.
    The formation of the Council of Common Interests was not constitutional, the petition maintains.

    Elections delay inevitable as ECP announces delimitation schedule

    The Election Commission of Pakistan (ECP) has announced the schedule of delimitation of constituencies as required by Article 51 of the constitution of Pakistan and section 17(2) of the Elections Act 2017, in accordance with the official results of the 7th Population and Housing Census-2023. The schedule makes it almost impossible to conduct elections in the next 90 days, as per constitutional requirements.

    According to the given schedule, the final publication of the delimitation will be on December 14th, 2023.

    As per the schedule, boundaries of administrative units across the country will stand frozen from today (August 17) and delimitation committees for all the provinces and the federal capital will be formed by Aug 21.

    In another notification, the ECP has directed its provincial chief secretaries, chief commissioner, the federal government, and the Pakistan Bureau of Statistics to provide assistance in the process.

    According to Bol News, US Secretary of State Antony Blinken has congratulated caretaker Prime Minister of Pakistan Anwaar-Ul-Haq Kakar on assuming office.

    “Congratulations to the new Pakistan Interim Prime Minister, @anwaar_kakar. As Pakistan prepares for free and fair elections in accordance with its constitution and the rights to freedom of speech and assembly, we will continue to advance our shared commitment to economic prosperity,” Blinken tweeted.

    In response, Anwaar Kakar said on Thursday that “The caretaker government would assiduously work to facilitate a free and fair election in the country”.

    Anwaar Kakar also thanked the US Secretary for his good wishes and said in his tweet “We place importance on our partnership with the US and deeply value the shared commitment to economic prosperity, democracy, and stability in the region”.

    Deputy Inspector General of Police (DIG) Lahore, Imran Kishwar, has said in an interview that after receiving the order to arrest former Prime Minister Imran Khan, when police reached Zaman Park, the doors were locked, thus requiring the need to break them down.

    The DIG told Geo News that while searching the premises, he found ash and taweez in a box. He further said that when I touched them, Imran Khan’s wife, former First Lady Bushra Bibi, resisted and said, “You should not touch them; they are sacred things”. 

    Bushra Bibi misbehaved with the police officials and said, “Police walay hain, Paisy lainy aye hoon gay,” [They are policemen. Must have come to take money], the DIG narrated. 

    Imran Khan got arrested in the Toshakhana case on August 5 and was transferred to Attock jail for a 3-year sentence on the same day.

    Ali Mardan Domki will be the interim CM of Balochistan

    Balochistan’s Chief Minister, Abdul Quddus Bizenjo, and the Leader of the Opposition, Malik Sikandar, have mutually decided to appoint Mir Ali Mardan Khan Domki as the caretaker Chief Minister of Balochistan, Geo News has reported. 

    Balochistan Assembly was dissolved on August 12 when Governor Malik Abdul Wali Kakar signed the summary of dissolution.

    Ali Mardan Domki is the son of Mir Hazor Bakhsh Domki, who served as senator from 1975 to 1977. The interim CM belongs to the Lahri area of Balochistan.

    After the dissolution of the Sindh and National Assembly, the Balochistan Assembly was the last one to be dissolved.

    Governer Sindh, Kamran Tessori, signed the summary of dissolution moved by CM Sindh Murad Ali Shah on August 11, a day before the completion of the assembly’s constitutional term.

    Caretaker Prime Minister Anwaar-ul-Haq Kakar is expected to announce the federal interim cabinet in the next few days.

    Relief for PTI; IHC issues release orders for Shandana Gulzar and Shehryar Afridi

    The Islamabad High Court (IHC) has on Wednesday ordered the immediate release of Pakistan Tehreek-e-Insaf (PTI) leaders Shandana Gulzar and Shehryar Afridi after suspending their arrest warrants under Maintenance of Public Order (MPO).

    The IHC had previously ordered that both Shandana Gulzar and Shehryar Afridi be presented in court.

    IHC conducted a hearing against the detention of both the leaders under the MPO on Tuesday.

    Afridi’s lawyer Sheer Afzal Marwat told the court that, “This is the seventh MPO order passed against Afridi, and the accused has been in jail for 90 days.”

    IHC judge Justice Babar Sattar asked, “Before this, which MPO order was passed by the deputy commissioner?”. The order against Shehryar Afridi was then read aloud by the counsel.
    The lawyer told the court, “Arrests were made in seven cases, but his client was later released on bail. Seven MPO orders issued against Shehryar Afridi so far have been declared illegal by courts.”

    The court further asked, “Where the MPO has not been issued?” To this question, the lawyer told the court that MPO orders have not been issued in Balochistan and Sindh.

    Justice Babar Sattar remarked, “If you have to keep a citizen in custody, you will have to provide reasons.”

    The court restricted Shehryar Afridi from speaking on media or social media until the trial ends.

    Hina Parvez Butt’s son protects her after she is attacked in London

    Pakistan Muslim League Nawaz (PML-N) leader Hina Parvez Butt has been attacked by supporters of political arch-rivals Pakistan Tehreek-e-Insaf (PTI) during a trip to London. The former legislator took to X (formerly known as Twitter) on August 14, at 1:13am PST, posting a video in which she can be seen coming under attack by PTI supporters in front of her son, as they threw bottles at her and hurled abuses. She questioned whether such people are defaming Pakistan or not.

    In the video she shared, her son can be seen protecting her by holding her and gently patting her back.

    She has decided to take the matter of assault in London up with the city’s police and press charges against the harassers today as reported by Murtaza Ali Shah.

    Journalist Ailia Zehra condemned the act of violence by mentioning that attacking a woman in front of her child is a despicable act.

    Broadcast Journalist Najia Ashar stated this act is disgusting and there is no justification for such behavior.

    Digital Journalist Saadia Ahmed also questioned the act.
