    Imran restarted cycle of political victimization, now he is facing the music: Bilawal Bhutto

    Pakistan Peoples Party Chairman Bilawal Bhutto appeared on BBC Urdu for an exclusive interview on October 24 in which he talked about the recent 26th Amendments and the controversies revolving around it.

    Journalist Farhat Javed asked the PPP Chairman about the government’s insistence on passing the amendments before October 25, to which he replied: “We did have a window because we’ve seen how other judges have moulded the constitution whether it’s Article 63A or the Reserved Seats’ case to serve their personal interests. And then, on the other hand, we had a Chief Justice [Qazi Faez Isa] who could withstand pressure from fellow judges that may try to instigate him… We had a window [before Oct 25] because this man wouldn’t try to undermine what we were doing. It wasn’t possible to do such a significant thing with the presence of any other Chief Justice.”

    The journalist asked Bilawal if Justice Mansoor had been the Chief Justice, then the amendments couldn’t have been passed. Bilawal replied: “This is our stated position that the Reserved Seats’ verdict was specifically orchestrated to undermine the strength of Parliament. The verdict on Article 63A was not based on the constitution but political motives.”

    Speaking about the Pakistan Tehreek-e-Insaf’s (PTI) claims about the illegitimacy of the current government, Bilawal remarked, “Which Assembly has had legitimacy in the past? When we came in 2008, did we not protest that our mandate and 2/3rd majority had been stolen from us? Even then we made constitutional amendments. When Zia ul Haq made constitutional amendments, they were legitimised by the superior courts. PTI calls us Form 47, and we call them Selected.”

    Speaking on the allegations of the establishment’s pressure on PPP to pass the amendments, Bilawal stated: “These claims are lies. I have worked for the Charter of Democracy. I have done these amendments because of my mother.”

    Farhat Javed then asked the PPP Chairman what has he done to end the violence and victimization cycle in Pakistan’s politics. Bilawal sternly replied: “What have I not done to end this cycle? When my father’s neck and tongue were slit, when he was imprisoned for more than 11 years, did we do the same things to the opposition when we came into power? No, we did not. PPP, not anyone else, ended this cycle. This cycle ended in 2008 in Pakistan’s history. Who broke the cycle? Imran Khan Niazi. He used to call it ‘muk mukaa’ or ‘Jail is for punishment, not vacations’, and he is bearing the consequences for what he did. If the [violence] cycle needs to end, then he [Imran Khan] has to do it. And he is in no mood to end the cycle, so it will keep on going.”

    “Do you expect someone who has been involved in the incarceration of your father, the torture of your mother and the torture of three generations of your family? I vould have taken revenge for blood. But I say that democracy is the best revenge for them,” concluded Bilawal.

    In an interesting development, prominent journalist Fakhar Durrani revealed why the government didn’t want Justice Mansoor Ali Shah as the next chief justice of Pakistan.

    Speaking on ‘Fact Check Pakistan,’ he disclosed that things started turning against Justice Shah after he announced the reserved seats verdict on 12 July.

    On July 12, the Supreme Court of Pakistan declared Pakistan Tehreek-e-Insaf eligible for reserved seats of Women and non-muslims.

    Chaired by Chief Justice Pakistan Qazi Faez Isa, the 13-member larger bench was hearing the appeal filed by the Sunni Ittehad Council party against the Peshawar High Court’s (PHCs) recent reserved seat verdict.

    Justice Mansoor Ali Shah, a second senior judge in the top court (counting Qazi Faez Isa as the first), had announced the majority eight-member verdict on reserved seats and ordered the Election Commission of Pakistan (ECP) for the allotment of Women and non-muslim seats to PTI.

    The other eight member judges, along with Justice Mansoor Ali Shah, were Justice Shahid Waheed, Justice Ayesha Malik, Justice Irfan Saadat, Justice Athar Minallah, Justice Munib Akhtar, Justice Hasan Azhar Rizvi, and Justice Muhammad.

    Fakhar Durrani stated that following the verdict on reserved seats, Justice Shah reportedly sent a WhatsApp message to one of his wives, which the country’s agencies intercepted and informed the government about it.

    “Main ne tumhary leader kay liye ye kar diya hai,” Fakhar Durrani quotes the message.

    He also said that Justice Mansoor Ali Shah’s further conversation was collected, which was reportedly biased towards Pakistan Tehreek-e-Insaf (PTI).

    Based on Shah’s tilt toward PTI and the fear that Shah Could give the government a tough time, the ruling government decided to pass the 26th Constitutional Amendment before October 25, the date when Chief Justice of Pakistan (CJP) Qazi Faez Isa would retire as CJP, Durrani added.

    Durrani also claimed that Chairman Pakistan Peoples Party (PPP) Bilawal Bhutto Zardari, while giving the reason for the judiciary’s past controversial verdict and citing the top court verdict on the disqualification of former prime minister Nawaz Sharif, convinced Jamiat Ulema-e-Islam Fazl (JUI-F)

    “There should be a process of accountability for judges, and parliament should have a role in the appointment of judges,” Bhutto had said.

    Clarifying why Justice Mansoor Ali Shah’s message was not made public, the journalist claimed that the message was not public by the government amid fear of being disgraced internationally.

    Justice Mansoor Ali Shah has not responded to this latest development that journalist Fakhar Durrani claimed.

    Chairman of the Pakistan Peoples Party (PPP) Bilawal Bhutto Zardari paid tribute to Chief Jamiat Ulema Islam (JUI-F) Maulana Fazlur Rehman in parliament over his support for the 26th Constitutional Amendment.

    “Other than President Asif Ali Zardari, the second person I respect for their politics is Maulana Fazlur Rehman,” he said while addressing the National Assembly session on Sunday night.

    “Maulana’s efforts contributed the most to the success of the 26th Constitutional Amendment,” he maintained.

    Praising the political parties who voted in favour of the Constitutional Amendment bill, he forgot to mention the name of the Balochistan Awami Party (BAP).nehen his fellow lawmakers reminded him, he humorously stated, “How we can forget BAP, without BAP amendments can’t be passed.”

    Recalling the former dictators who ruled the country for around 33 years, he, in euphemistic words, declared the judiciary responsible for facilitating Martial laws over the past years.

    Chairman Pakistan Peoples Party (PPP) Bilawal Bhutto Zardari praised Chief Justice Pakistan (CJP) Qazi Faez Isa over his verdicts on risky cases in the past.

    Speaking at a PPP rally in Hyderabad held to mark the 17th anniversary of the Karsaz incident, Bilawal Bhutto Zardari, in a roaring tone, remarked that Qazi Faez Isa delivered a brave judgement on the Faizabad Dharna case, which no other judge had the courage to deliver.

    “History will remember you (Qazi Faez Isa) for declaring former dictator General Musharraf a traitor and showing courage in calling Musharraf a dictator,” the former Foreign Minister stated.

    “The nation salutes you,” he added.

    Responding to the political parties’ lack of consensus on the 26th Constitutional Amendment in parliament, Bhutto said that he would be forced to push the Constitutional Amendments through parliament using a “brute majority” to break the ‘one unit’ system in the judiciary.

    “It is my desire to have consensus among all political parties in parliament for this amendment. The second option, which is not my preferred path, is to rely on the majority’s vote to pass it,” he maintained.

    However, the incumbent government is reportedly short of 13 votes in the National Assembly (Lower House) and nine in the Senate (Upper House) to pass the Constitutional amendments.

    Feigning a surprises expression, he asked Bokhari who claimed that judges will resign. When told it was Fawad, he said, “Well then, we’ve lost… I give up… Fawad Chaudhry has spoken, so why are we even continuing this interview?”

    The former Foreign Minister couldn’t help but laugh as Mehr Bokhari went on to narrate the full quote, stating: “Mehar, calm down! He has nothing to do with the constitutional amendments.”

    A delegation of Pakistan Tehreek-e-Insaf (PTI) met Chief Jamiat-e-Ulema Islam Fazl (JUI-F) Maulana Fazlur Rehman on Wednesday to inquire about his stance on the incumbent government’s proposed constitutional amendments.

    The government intends to table the constitutional amendment in parliament after the Shanghai Cooperation Organisation (SCO) summit, which is taking place on October 15 and 16.

    The PTI delegation led by Chairman PTI Barrister Gohar Ali Khan included Advocate Salman Akram Raja, Hamid Khan and Raoof Hassan. They discussed the political situation in Pakistan and the twenty-sixth constitutional amendment at Maulana Fazlur Rehman’s residence.

    Speaking to the media after the meeting, Barrister Gohar Ali Khan said, “We will review the draft of the 26th constitutional amendment first, and only then can we discuss it. But the government has turned it into a mystery.”

    He said that both JUI-F and PTI believed in the independence of the judiciary.

    Meanwhile, Chairman Pakistan Peoples Party (PPP) Bilawal Bhutto Zardari claimed that the government wanted to create a consensus among all political parties, including JUI-F, on the 26th constitutional amendment.

    He predicted on Tuesday that the constitutional amendment will be passed by the parliament by October 25.

    Speaking to journalists on Wednesday, Bilawal Bhutto said, “There is no deadline from our side for the constitutional amendment.”

    Bhutto remarked that the government has the option to secure the required majority number under “conscience voting,” adding, “Despite this, efforts are being made to reach a consensus.”

    A partial video clip of Chairman Pakistan Peoples Party (PPP) Bilawal Bhutto was circulating online, giving the impression that he said that Justice Mansoor Ali Shah of the Supreme Court wouldn’t be able to control the other top court judges.

    Appearing on Dunya News programme, ‘Dunya Meher Bokhari Kay Sath,’ he actually remarked, “I don’t have the confidence that Justice Mansoor Ali Shah will be able to control the other judges, Some of whom have shown a tendency that be it in the 63A case, be it in the original practice and procedure case whatever their position may be today, they have time and time and time again proved that they willing to go beyond the constitution to achieve a political aim.”

    He further said, “PPP respects both Chief Justice Pakistan Qazi Faez Isa and Justice Mansoor Ali Shah,” and added that some judges have attempted several times to go beyond the 63-A Practice and Procedure case to achieve their political objectives.

    Bilawal claimed that for the first time in history, a chief justice “shared his authority” with another judge, and this happened during the Chief Justice of Pakistan (CJP) Qazi Faez Isa’s tenure.

    Vice Chairman of the Pakistan Bar Council (PBC), renowned lawyer Farooq Hamid Naek said on Wednesday that there will be two Chief Justices in Pakistan after the formation of the new Federal Constitutional Court (FCC).

    Vice Chairman of the Pakistan Bar Council from Islamabad claimed that one Chief Justice will head the Federal Constitutional Court while the other will lead the Supreme Court of Pakistan, ARY News reported.

    He further stated that constitutional court judges’ performance will be recorded, and they could be removed through the Judicial Commission based on recommendations, adding that the Committee will propose names for the Chief Justice of the Constitutional Court.

    Naek further said that the Federal Constitutional Court will have representation from all four provinces of Pakistan.

    Chairman of the Pakistan Peoples Party, Bilawal Bhutto, has been campaigning to win the confidence of lawyers nationwide for the formation of a Constitutional Court.

    Addressing the Balochistan High Court Bar Association, the PPP Chairman stated, “If you don’t accept the constitutional courts, you should leave the practice.”

    Meanwhile, some lawyers have rejected the formation of a new constitutional court.

    Speaking at the All Pakistan Lawyers Convention (APLC) organised by the Islamabad Bar Council (IBC) on Monday, lawyers condemned the judicial package and declared it a tactic by anti-democratic forces to control the independence of the judiciary.

    Pakistan Peoples Party (PPP) chairman Bilawal Bhutto while talking to journalists during a meeting with Supreme Court Press Association’s delegation on October 2, warned of a “face-off like situation” in the country if the constitutional amendments were not passed before October 25.

    It should be highlighted that Chief Justice of Pakistan Qazi Faez Isa is set to retire on October 25 this year.

    Bilawal has been at the forefront of campaigning for the coalition government’s decision to pass the constitutional amendments ever since it failed to do so last month.

    Last month, the government remained unsuccessful in convincing JUI-F Chief Maulana Fazl ur Rehman as opposition and government leaders raced to woo him.

    “The matter will be resolved peacefully if the amendment is passed before October 25. Otherwise, the situation could lead to confrontation,” warned Bilawal.

    He reiterated the PPP’s goal to establish a constitutional court – a goal set in the Charter of Democracy signed by the slain former Prime Minister Benazir Bhutto and Nawaz Sharif in 2006.

    Bilawal blamed the judiciary for being biased and political, questioning the top court’s reserved seats verdict.

    Interestingly, he also stated that when Law Minister Azam Nazeer Tarar apprised the SC judges of judicial reforms, then “they [SC Judges] instantly announced the verdict in the reserved seats case which is direct interference.”

    Meanwhile, Jamiat Ulema-e-Islam (JUI) leader Senator Kamran Murtaza told Geo News that he won’t cooperate with anyone under threat of bloodshed and pressure, in reference to Bilawal’s statement.

    Chairman Pakistan Peoples Party (PPP) Bilawal Bhutto Zardari said on Thursday that he supported the coalition government’s proposed formation of constitutional courts in the since-postponed constitutional amendment legislation.

    “At least 50 percent of the cases in Supreme Court are constitutional — which consumed 90 percent of the time,” claimed the PPP leader, asking why a separate court should not be established for better dispensation of justice.

    Bhutto also emphasised that if citizens are not satisfied with the current judicial system, then a constitutional court must be established.

    Interestingly, the former foreign minister also stated that the proposed legislation by the government was “inadequate” because constitutional courts should be established at the provincial level as well.

    He also stressed that there is a need to revise the judicial appointment system, saying, “Parliament has decided that people will decide who will become the judge.”

    Bilawal alleged, “In Pakistan, there is a tradition that if you’re someone’s relative, you can become a judge,” adding that it has severely damaged the judicial system in Pakistan.
