  • Federal Shariat Court declares ‘compensation marriages’ to resolve disputes un-Islamic

    A three-judge bench, headed by Chief Justice Noor Mohammad Meskenzai, observed that the tradition of giving away a minor girl to settle disputes was against the teachings of Islam, Malik Asad reports for Dawn.

    Taking up a petition filed by Sakeena Bibi, the bench held that Ulema had come to an agreement that vani, or swara, was against the teachings of Islam.

    Swara is a tradition where girls, often minors, are given for marriage or servitude to a distressed family as compensation to solve disputes, often murder. It is a punishment decided by a jirga (group of tribal elders).

    The petitioner challenged the custom of vani for many reasons. According to the petition, the tradition which is being practiced in jirgas and panchayats seizes the fundamental rights of a woman or minor girl. The petitioner requested the court to declare this custom as illegal.

    Dr Mohammad Aslam Khaki, Jurist Consult at FSC, said vani violated at least four basic rights. According to him, since the girl is offered by the accused family, she in most of the cases is not provided with even basic facilities, hence subjected to discrimination.

    Secondly, she is wedded to a man without her consent. Thirdly, she is not entitled to dower, and fourthly, she cannot file legal suit for khula — dissolution of marriage.

    According to Dr Khaki, the legitimate way to settle a murder is payment of diyat or blood money, which is allowed in Islam. However, traditional forums especially in rural areas consider vani or swara as a legitimate way to settle disputes. But Ulema do not accept the practice as Islamic.

    Renowned religious leader Mufti Tariq Masood has come under fire over a sermon wherein he is endorsing child marriages and paedophilia, guaranteeing his followers a minor bride as their fourth wife if they marry three widows or divorcees.

    “Change my name if I don’t get you a fourth and virgin wife after you marry three widows or divorcees,” he was heard as saying in an undated video doing the rounds on social media.

    “Mufti Tariq Masood will find you a 16-year-old or two eight-year-olds or four four year-olds,” he tells his followers after which they, as well as the cleric himself, start laughing.

    The video surfaces as Pakistan reports over 90 rape cases within a single month, most of which involved minors.

    The latest case that shook the entire nation remains that of a four-year-old who, along with her mother, was repeatedly subjected to sexual assault in the Kashmore district of Sindh.

    The minor girl is currently admitted to a hospital battling for her life.

    Medical test proves Arzoo Raja is a minor

    A medical test has proven that Arzoo Raja, the teenage Christian girl who was allegedly abducted before being forcefully converted and married to a Muslim man, is around 14 years of age, social activist and lawyer Jibran Nasir announced on Monday.

    According to Jibran, who is part of the legal team fighting the case on behalf of Arzoo’s parents, the Sindh High Court (SHC) has also recognised NADRA (National Database & Registration Authority) documents stating Arzoo’s age to be 13 as true.

    “[The court] declares prima facie [at first sight] she contracted child marriage. Arzoo to remain in shelter home till next hearing,” he tweeted.

    In a subsequent tweet, Jibran added that the court has not disposed off the petition and the next hearing will be held after two weeks.

    “Court is yet to determine whether #Arzoo is sui juris [of one’s own right] to convert religion of free will given her age of 13. At this stage, only question of child marriage has been addressed and resolved,” he said further.

    Earlier, amid public outrage, Sindh government spokesperson Murtaza Wahab had announced Arzoo’s recovery.

    Speaking to Dawn, acting Karachi police chief Additional IG Arif Hanif had confirmed that the 13-year-old girl had been recovered safely and her purported husband had also been arrested.

    The city police chief had said the girl would be sent to a shelter home as per the directions of the SHC while the suspect would be presented before the court.

    “The judge has ordered the girl be recovered by police and relevant agencies and shifted to a shelter home. Next hearing fixed for Thursday morning [November 5]. My lawyer has informed the court that an intervener will be filed on my behalf,” Minister for Human Rights Shireen Mazari had said in a tweet.

    Officials, including Sindh Governor Imran Ismail, have been reiterating resolve of the authorities concerned to resolve Arzoo’s case at the earliest.
