    Khaqan Abbasi thinks it’s ‘ethically wrong’ for PM to engage Farogh Nasim

    Former Prime Minister Shahid Khaqan Abbasi has said in a TV show that he is not aware of the appointment of former law minister Barrister Farogh Naseem as a lawyer for Prime Minister Shehbaz Sharif.

    He further said on Sawal Yeh Hai that he doesn’t know who makes the appointment, but firmly declared that it is ethically wrong to engage a person as a lawyer if he has been accused by the same government.

    Farogh Naseem, a law minister in the previous government, will represent Shehbaz Sharif in a case pertaining to civilian trials in military courts.
    The Premier has chosen Naseem to be his attorney in the matter. Following the arrest of their party chairman, angry protestors from the Pakistan Tehreek-e-Insaf (PTI) vandalised army installations, prompting the government to decide to try civilians under army laws.

    Special Assistant to PM Shehbaz, Malik Ahmad Khan, also said that he has disagreement with the political position of Farogh Naseem.

    Muttahida Qaumi Movement-Pakistan (MQM-P) leader Amir Khan in a Geo News‘ programme ‘Aaj Shahzeb Khanzada Kay Saath‘ said that the party seeks mercy from the government, doesn’t want any more ministries and the government can take back the MQM-P’s current federal cabinet seat.

    Currently, MQM-P holds two federal ministries— Information Technology Minister Syed Amin-ul-Haq and Law Minister Farogh Naseem. However, MQM-P has been saying that the law ministry has not been given to it.

    Amir raised serious concerns about government policies. He stated, “Our legs have started trembling, carrying the weight of the government’s economic policies.”

    “We have our own identity and are independent in making decisions; we are not obligated to work with the Pakistan Tehreek-e-Insaf (PTI)-led government, and we will make decisions as we deem appropriate”, he added, while talking about the no-confidence motion against Prime Minister (PM) Imran Khan.

    Talking about the recent meetings with the Opposition who are gearing up for the no-confidence motion, the MQM-P leader stated, “The Opposition should have a clear stand on a vote of no confidence.” He demanded that the party wants an independent local bodies system in Sindh, and if contacted, they will present Sindh problems before the Opposition.

    On the contrary, while speaking on Geo News‘ Programme ‘Jashan-e-Cricket’, MQM-P leader Wasim Akhtar said that their party has a lot of compulsions to support PTI yet he questioned the incumbent government wining in Karachi. He claimed that PTI would not have won 14 seats in Karachi if Khalai Makhlooq (‘Aliens’) had not played a role.

    Akhtar further said that he wondered, “How Imran Khan has become Prime Minister of Pakistan.”

    It was reported on Wednesday that the premier would soon make changes in the federal and Punjab cabinets by including allied parties’ members i.e MQM-P and Balochistan Awami Party (BAP).

    In a press conference on Friday, Pakistan Tehreek-e-Insaf’s (PTI) parliamentary secretary on law Maleeka Bokhari announced that the bill passed on the chemical castration of rapists has been revoked.

    “We have amended the criminal law and decided that the chemical castration clause will be taken out,” said Bokhari.

    She said the decision was taken after the Islamic Ideology Council, a state-run body that interprets laws from an Islamic perspective, found chemical castration un-Islamic.

    While talking about the Anti-Rape Bill 2021, Bokhari announced the abolishment of the “two-finger virginity test”. Moreover, according to her Pakistan’s rape conviction rate is less than 1- 2 per cent that’s why the government has introduced the setting up of Special Courts to avoid delays in the proceedings of rape cases.

    Furthermore, under the new bill, she announced that National Database and Registration Authority (NADRA) would register sex offenders so the government would have a record of such people.

    “In an effort not to disclose the victim’s identity instead of open trial, video trials would take place under the new Anti-Rape Bill”, she added.

    The Anti-Rape (Investigation and Trail) Bill 2021 also includes:

    1- Creation of anti-rape crisis cells in public hospitals to ensure prompt registration of the FIR, medico-legal examination

    2- Use of modern devices during investigation and trial.

    3- The accused is barred from the cross-examination of a rape survivor.

    4- Evidence pertaining to the ‘immoral character’ of the victim is inadmissible in court.

    5- Setting up a public reporting mechanism.

    President Dr Arif Alvi on Wednesday signed an ordinance that sharply reduces the jurisdiction of the National Accountability Bureau (NAB) and enables the president to reappoint the incumbent NAB chairman or extend his tenure, reports Dawn.

    Federal Law Minister Barrister Dr Farogh Naseem and Minister for Information and Broadcasting Chaudhry Fawad Hussain earlier held a press conference and explained that the law would enable NAB to focus on mega corruption cases.

    The salient features of the ordinance, as reported by Dawn, are: the National Acco­untability Second Ame­n­dment Ordinance 2021 has amplified the Opposition’s role in the appointment of the NAB chairman.

    “All matters pertaining to Federal, Provincial or Local taxation, other levies or imposts, including refunds, or loss of exchequer pertaining to taxation will be dealt with in accordance with the revenue or banking laws and will be transferred from the accountability courts to the courts of competent jurisdiction.”

    “NAB cannot proceed against any person or entity who, or transaction in relation thereto, which are not directly or indirectly connected with the holder of a public office…procedural lapses in any public or governmental work, project or scheme, unless it is shown that a holder of public office or any other person has been conferred or has received any monetary or another material benefit from that particular public or governmental work.”

    “The ordinance has amended Sub-section (b) of Section (6) of the National Accountability Ordinance (NAO) to grant extension in the tenure of the NAB chairman by excluding the word non-extendable from the statute.”

    “However, it has retained the proviso that makes consultation between the Opposition leader and the leader of the house in the National Assembly on the appointment of NAB chairman but states that the president would consult both of them.”

    “The ordinance has increased the role of the Opposition and enhanced the parliamentary oversight as it has provided a forum of a 12-member parliamentary committee in case the consultation between the Prime Minister and the Opposition leader proves futile.”

    “The ordinance has enhanced the authority of prosecutor general of NAB empowering him to play a crucial role in advising the chairman to file or withdraw any reference from the court. It has also allowed the accountability court to grant bail to any accused.”

    The government has decided to give an extension to National Accountability Bureau (NAB) Chairman Justice (retd) Javed Iqbal and a draft ordinance has been prepared, Ayaz Akbar Yousafzai reports for Geo News.

    Law Minister Dr Farogh Naseem, Adviser to the Prime Minister on Parliamentary Affairs Dr Babar Awan, and Adviser on Interior and Accountability Mirza Shahzad Akbar suggested changes in the law.

    According to sources privy to the matter, more than one amendment has been proposed.

    Geo reports that Prime Minister Imran Khan will chair a meeting today (Tuesday), in which a final approval will be given to the proposal drafted in consultation with federal ministers.

    The tenure of a NAB chairman cannot be extended under section 6(b) of the NAB Ordinance 1999.

    Earlier, Pakistan People’s Party (PPP) Chairman Bilawal Bhutto-Zardari tweeted that the PPP will forcefully oppose the illegal extension in the tenure of Chairman NAB.

    The Ministry of Law and Justice has reportedly been preparing a summary to send to the Prime Minister (PM) Imran Khan regarding the extension of sitting Chairman of the National Accountability Bureau (NAB) Justice (redtd) Javed Iqbal, reported Malik Asad for Dawn.

    The four-year term of Justice Iqbal as NAB chairman will expire this month. A senior official of the ministry has confirmed that they will send the proposal to the PM soon.

    However, the government hasn’t taken a final decision yet. According to an official, in the proposal, the declaration of an ordinance for giving extension has been suggested.

    “In case the PM decides to grant an extension to the chairman, the law ministry will draft an ordinance to amend the National Accountability Ordinance (NAO) and forward it to the president,” the sources said.

    If PM agrees, an amendment will be made in sub-section b of Section 6, which states, “There shall be a Chairman NAB to be appointed by the President in consultation with the [Leader of the House and the Leader of the Opposition in the National Assembly] for a [non-extendable] period of [four] years on such terms and conditions as may be determined by the President and shall not be removed except on the grounds of removal of Judge of Supreme Court of Pakistan.”

    Earlier, Information Minister Fawad Chaudhry said, “The government has decided not to consult Opposition Leader Shehbaz Sharif for the appointment of NAB chairman since he (Sharif) is accused in several corruption references filed by the bureau.”

    Later, Pakistan People’s Party (PPP) chairman Bilawal Bhutto Zardari tweeted that PPP will forcefully oppose the illegal extension in the tenure of chairman NAB.

    A total of 19 bureaucrats of grade BS-22 secured three housing units each, including Special Assistant to the Prime Minister on Establishment Shehzad Arbab.

    According to the papers obtained by Dawn, the officers had already been allotted a double-story “grey structures” house each in the Pakistan Housing Authority Foundation (PHAF) scheme.

    The PHAF traditionally built low-cost housing schemes for its members and this was the first time that it introduced a scheme for senior bureaucrats.

    Previously, former prime minister Nawaz Sharif had cancelled the allotment of “choice” apartments to influential bureaucrats in the same locality [PHAF] and ordered an investigation into the manipulated balloting carried out by the housing scheme.

    Not only this, the official documents say that 185 of the 588 bureaucrats right after this allotment were allotted plots in the capital’s new sectors of F-14 and F-15.

    Following this, the Federal Government Employees Housing Authority (FGEHA) recently allotted two plots each to senior bureaucrats, judges of superior courts, lawyers, and judicial officers of Islamabad’s subordinate judiciary.

    Earlier, the Islamabad High Court (IHC) ruled against the allotment of more than one plot to top bureaucrats at public expense under Article 25 of the Pakistan Constitution and then set aside the policy of allotment of the second plot and referred the matter to the federal cabinet.

    While talking to Dawn, Federal Minister for Law and Justice Barrister Farogh Naseem said the allotments would be examined in light of the IHC judgment. Federal information minister Fawad Chaudhry said, “The government is working on the issue in the light of the IHC directive and has formed a committee as well.”

    Initially, civil servants were entitled to one plot each only. However, in 2006, the then prime minister allowed two plots each for BS-22 officials.

    However, an insider said the policy to make such allotments had never been approved by the federal government.

    Federal Minister for Law and Justice Farogh Naseem and Adviser to the Prime Minister on Accountability Shahzad Akbar have denied serious allegations levelled by ex-FIA director general (DG) Bashir Memon.

    Reacting to Memon’s statement, wherein he had accused PM Imran among others of framing Justice Qazi Faez Isa and major political player, the premier’s adviser on accountability Akbar vehemently rejected the same.

    He said Memon had committed “slander” and said he had directed his lawyers to initiate legal action against the former head of the FIA.

    “Just seen absolute rubbish uttered by Bashir Memon on Shahzeb show. He was never called for any meeting with PM or myself on QFI (Qazi Faez Isa) issue, and there was no meeting with law minister and him as he claims,” he said in a tweet, “similarly he was never told to start any case against any specific individual. Only case referred to FIA was of sedition by the fed cabinet. I have instructed lawyers in personal capacity to initiate legal action for his slander.”

    Law minister Naseem said all allegations levelled by Memon were false and baseless, adding that he never spoke a word to the former DG FIA about Justice Isa. He also pinpointed that Azam Khan, Shahzad Akbar and Bashir Memon had never showed up at his office, contrary to Memon’s allegations.

    “PM Imran Khan, Azam Khan, or Shahzad Akbar never told me that they had a word about Justice Isa with Bashir Memon,” he added.

    The Prime Minister (PM) Imran Khan-led government is considering a proposal to promulgate an ordinance that would restrict children from evicting their aging parents from their homes.

    According to Dawn, Federal Law Minister Dr Farogh Naseem has discussed the proposal with the premier to promulgate the ordinance to prescribe the right of parents to evict their children and their spouses and protect the rights of parents living with their children, a Law Ministry statement said.

    He informed PM Imran that the ordinance should focus on three things:

    1. Firstly, It should restrain children from evicting their parents from their homes if the houses are owned by the children.
    2. Secondly, if the houses are owned by parents, they should have the right to evict children and their spouses through simple procedures i.e. within 10 days through intervention of the police or district management.
    3. Thirdly, if houses are constructed with funds provided by parents or grandparents, but they are registered in the names of children, some remedy is to be provided to parents till the time they are alive.

    The minister told the PM that if such an ordinance were promulgated, it would earn the premier, law minister, the entire cabinet and also the president prayers of all parents of Pakistan.

    “Within a matter of seconds, the PM approved the proposal and asked me to urgently draft the ordinance,” reports quoted Naseem as saying.
