    Government clarifies no military trial for Imran Khan

    The federal government clarified to the Islamabad High Court (IHC) that the possibility of a military trial for founder of Pakistan Tehreek-e-Insaf (PTI), Imran Khan, is not under consideration.

    Additional Attorney General (AAG) Barrister Munawar Iqbal Duggal remarked before the IHC that the defence ministry has not yet provided any information regarding former Prime Minister Imran Khan’s military trial.

    However, the AAG Duggal cleared to the IHC bench headed by Justice Miangul Hassan Aurangzeb that Khan’s military trial would be per the law if the military court tried him.

    Law official for Ministry of Defence, Brigadier Falak Naz remarked that civilian trials by the military court are possible for certain offences under Section 2(1) (d) of the Pakistan Army Act.

    Earlier, ex-PM Khan filed a petition against his possible military trial in connection with the May 9 violent protest cases, upon which IHC directed the incumbent government to submit its answer by September 24.

    Criminal evidence against the founder of Pakistan Tehreek-e-Insaf (PTI) Imran Khan and military evidence against former spymaster General Faiz Hameed pertaining to the May 9 riots, has been collected.

    Government sources told The News that the decision to hand Khan over to an army official on the pretext of an Army Act trial is yet to be made.

    Based on evidence, Khan’s trial will undoubtedly be in the military court. However, civilians could be exempted as their cases are pending in the Supreme Court, revealed the sources.

    A Cabinet Committee declared former Prime Minister (PM) Imran Khan guilty of the May 9 riots in the report prepared by the caretaker government.

    Report reads. “Evidence shown to the cabinet committee indicates several leaders were included in planning the May 9 riots, and Imran Khan contributed actively.”

    It further read, “Investigations conducted so far suggest there were 34 individuals who masterminded the strategy of violent street power, actively contributed to planning the violence and mayhem.”

    The Islamabad High Court (IHC) registrar office has objected to former Pakistan Prime Minister (PM) Imran Khan’s petition to bar his potential military trial in connection with the May 9 riots cases.

    The IHC registrar objected to the petition, stating that the petitioner could only seek relief while referring to a specific First Information Report (FIR). The court also highlighted the absence of any document and an order that should be attached to the petition.

    The IHC registrar further objected to how a petition could be filed with a high court while the matter of military trials is sub judice in the Supreme Court; registering cases in Punjab is impossible for a federal court to hear.

    Earlier, the founder of Pakistan Tehreek-e-Insaf (PTI) filed a plea under Article 199 of the constitution.

    Imran Khan’s counsel, Intezar Panjutha, questioned, “How can the leader of a popular political party be taken to a military court?”

    Khawaja Asif thinks Imran Khan’s trial will be in military court

    Defence Minister Khawaja Asif has said that Pakistan’s former Prime Minister (PM) Imran Khan’s trial will be open in a military court if it is connected with the May 9 riots.

    Talking on Shahzeb Khanzada’s talk show on Geo News, Asif said, “We don’t have any precedent that any general’s military trial was held in an open court in the country’s history.”

    He pointed out that there were 24 convictions during the Imran Khan-led government in the military trial court.

    He added, “If the PTI founder faces any trial in a military court, then I can assure you that it would be open to the public and media because he is a civilian.”

    Commenting on the May 9 riots, Asif said that manpower was provided by the founder of Pakistan Tehreek-e-Insaf (PTI), Imran Khan and strategies were done by Faiz Hameed to target military installations.
