    What are the pros and cons of the newly proposed constitutional court?

    After the coalition government failed to pass the much-discussed secret constitutional amendments last month, lawyers, journalists, and social media have been busy debating what the proposed amendments mean.

    Pakistan Peoples Party (PPP) Chairman Bilawal Bhutto has aggressively campaigned for judicial reforms and the establishment of a new constitutional court.

    On the other hand, many lawyers have called the proposed judicial reforms a travesty of justice, terming them draconian. Pakistan Tehreek-e-Insaf (PTI) has strongly condemned the amendments, alleging that the government wants to extend the tenure of CJP Qazi Faez Isa, who is set to retire on October 25 this year.

    In order to better understand the two sides, we’ve listed pros and cons of the proposed new constitutional court based on the analysis of legal experts: Advocate Hafiz Ahsaan Ahmad Khokhar, Advocate Salahuddin Ahmad, Barrister Asad Rahim Khan.

    Pros of FCC

    The proposed Federal Constitutional Court could ease up the burden on the Supreme Court. The apex court is swamped with pending cases, which means justice is delayed for the common citizens.

    Pakistan’s Supreme Court and high courts have become overburdened with increasing ‘constitutional cases’, according to the coalition government.

    There is a lower chance of a constitutional crisis as FCC rulings would be the final authority according to the leaked amendments bill.

    The proposed constitutional court could help ease political tensions as it would be the impartial arbiter in any federal-provincial disputes.

    In August 2023, the Civil Society of Pakistan published a report in which it expressed the need to establish a federal constitutional court in Pakistan.

    Cons

    Salahuddin argues that most backlogs in pending cases exist in lower courts, i.e. 58,000 pending cases in the Supreme Court, 400,000 cases in the High Courts and around 1.8 million pending cases in the lower courts

    The litigation time in the Supreme Court is the shortest as compared to lower courts because it has final authority.

    Reforms then, theoretically, should begin in lower courts, but politicians are concerned with reforming the Supreme Court.

    Advocate Salahuddin Ahmad argues that under the proposed amendments, the burden of constitutional cases would shift from one court (Supreme Court) to another court (Federal Constitutional Court), which would be meaningless.

    If politicisation of the Supreme Court is the issue, then under the proposed amendments, politicians having a greater role in the appointments of judges would only increase this problem.

    Transfers of High Court judges, proposed under the constitutional amendments, from province to province would cast serious doubts on impartiality and dispensation of justice.

    The First Chief Justice of the proposed FCC would be handpicked by the Prime Minister.

    Lawyer and activist Jibran Nasir has claimed that the government is trying to set up its own executive-judicial branch.

    Chief Minister (CM) Khyber Pakhtunkhwa (KP) Ali Amin Gandapur’s recent statement of answering a bullet with a bullet has been met with criticism, including former Senator Faisal Vawda who has said, “Gandapur kay baal katnay ka waqt agya hai.”

    Appearing on the ARY News programme OFF THE RECORD, Vawda said, “Courts ko Ali Amin Gandapur kay controversial bayanat par intervene karna chahiye thaa. (Courts should have intervened on his controversial statements.)”

    Lambasting the controversial conduct of former judges of Pakistan, he said, “It’s not the job of the judges to regulate vegetable prices and to demolish Nasla Tower.”

    “The impression that the division among Supreme Court judges benefitting the PTI is also incorrect,” Vawda added.

    In the same show, former Senator Mustafa Nawaz Khokhar maintained that CM KP Ali Amin Gandapur’s statement regarding the direct talk of the KP province with the Afghanistan government was baseless.

    Responding to the proposed constitutional amendments regarding the formation of the Federal Constitution Court (FCC), he emphasised the need for reforms in session courts, as the majority of cases are pending in lower courts.

    Punjab Governor Sardar Salim Haider Khan has advised Pakistan Tehreek-e-Insaf (PTI) head Imran Khan to shake hands with President Asif Ali Zardari for the betterment of Pakistan.

    Speaking at the first convocation of Rawalpindi Women’s University, Haider advised former Prime Minister (PM) Imran Khan that working under Zardari’s leadership would settle political unrest, Tribune has reported.

    The Punjab Governor stated, “Imran Khan needs to step out of his stubbornness. My advice is to sit under Zardari’s leadership, and everything will improve.”

    He also urged PTI leadership to put off protests until after the upcoming Shanghai Cooperation Organisation (SCO) summit, which is to be scheduled on October 15-16 in Islamabad and added, “Revolutions don’t happen with ministers, convoys, and official resources.”

    Citing the past disrupted diplomatic events by PTI protests during the visit of President of China Xi Jinping and Saudi Crown Prince Muhammad Bin Salman to Pakistan, Haider said, “They (PTI) send the wrong message to the world, discouraging foreign leaders from engaging with Pakistan.”

    Fact-check: Is PM Shehbaz Sharif’s UN address the most watched on the UN’s YouTube channel?

    The government on Monday, shared a picture on the Instagram page ‘govtofpakistan’ which claimed that Prime Minister (PM) Shehbaz Sharif’s United Nations General Assembly (UNGA) speech got more views than any world leader on the official YouTube channel of the UN.

     

     

    The Prime Minister’s Office (PMO) said that PM Shehbaz Sharif’s speech was watched by 137,000 viewers on the UN’s official channel.

     

    Speaking at a press conference in Islamabad, Federal Minister of Broadcast and Information Attaullah Tarar, while declaring the success of Pakistan’s foreign policy, said, “Pakistan Prime Minister Shehbaz Sharif’s address was most watched at the UN General Assembly.”

     

    Is this claim true?

    On the YouTube channel of the United Nations, Pakistan PM Shehbaz Sharif’s address has not remained on top in terms of views, rejecting the Pakistan government’s claims of the most-watched premier at the UN.

     

    Shehbaz has 179,000 views on the UN’s official YouTube channel so far since it was uploaded on September 28.

     

     

    Meanwhile, Prime Minister of Israel Benjamin Netanyahu was watched 212,000 times and remains on top in terms of views on YouTube.

     

    The President of the United States (US), Joe Biden, has a total of 110,000 views so far, since it was uploaded on September 22.

     

     

    President of Iran, Masoud Pezeshkian’s address has 152,000 views on the UN’s YouTube official channel.

     

    Furthermore, the address of the President of Palestine, Mahmoud Abbas, has 58,000 views.

     

     

    At the time the claim was made, Netanyahu had more views than Shehbaz on the UN’s YouTube channel. Journalist Mansoor Ali Khan also revealed this information on his YouTube channel.

    Information Advisor of Khyber Pakhtunkhwa (KP) Barrister Saif has claimed on Tuesday that former First Lady Bushra Bibi, wife of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan, is being mistreated in Adiala jail on Chief Minister Punjab Maryam Nawaz’s orders.

    Barrister Saif claimed that Bushra Bibi was frisked in jail continuously under the guise of prison check by the police in front of cameras and added that she was also mentally tormented after being forcefully awakened at night, ARY News has reported.

    He said, “Bushra Bibi kay through Imran Khan ko toornay ki koshish ki ja rahi hai.”

    Meanwhile, responding to Barrister Saif’s accusations, Punjab’s Information Minister Azma Bokhari said, “Maryam Nawaz is not even aware of which cell Bushra Bibi is in at Adiala Jail.”

    She further added, “Bushra Bibi can eat eggs, chicken, or chicken broth; Maryam Nawaz doesn’t care.”

    Imran Khan calls on PTI to organize nationwide protests

    Founder of Pakistan Tehreek-e-Insaf (PTI) Imran Khan has announced a series of nationwide protests by his party, including the federal capital Islamabad, with the aim of achieving the “independence of judiciary.”

    Addressing his supporters through a statement issued from Adiala Jail Rawalpindi on Monday, Khan announced that protests will be held at D Chowk Islamabad on October 4, at Minar-e-Pakistan in Lahore on October 5, and in Mianwali, Faisalabad and Bahawalpur on October 2 as well, Tribune has reported.

    Meanwhile, section 144 has been imposed at Faisalabad for October 2 and 3.

    Predicting that the protests would be peaceful, Khan said, “We have always protested peacefully, but this system has failed to protect us.”

    Imran Khan also backed Chief Minister (CM) Khyber Pakhtunkhwa (KP) Ali Amin Gandapur in his conduct on the recent PTI protest in Rawalpindi, stating, “Gandapur awakened the province’s people.”

    PTI called a nationwide protest despite a freshly passed public order law which noted: “Every party wanting to hold a protest has to appoint an event coordinator who would write to the district magistrate for permission to hold the gathering at least seven days before the intended date of the event.

    It also added, “Upon receipt of the application, the district magistrate, before granting permission, shall examine the prevailing law and order situation and obtain security clearance reports from law enforcement agencies.”

    Punjab Information Minister Azma Bokahri expressed concern on Monday over fake content on social media sites in her case and suggested that social media apps should be blocked if they are not regulated.

    Speaking to the media during her appearance at the Lahore High Court (LHC), She said, “Social media platforms are making money in Pakistan but are not accountable to anyone. If social media apps cannot be regulated, they better be shut down.”

    The information minister pointed out that social media was being regulated all over the world except in Pakistan.

    She further added, “Social media cannot be run without regulation. Whenever we talk about regulation of social media, the talk of freedom of speech comes in the way.”

    “Federal Investigation Agency (FIA) officials complain that they cannot question social media apps due to lack of capacity. This highlights the state of social media affairs in Pakistan, where everyone is free and unaccountable,” Azma Bokhari concluded.

    The incumbent government on Monday claimed that Prime Minister (PM) Shehbaz Sharif’s United Nations General Assembly (UNGA) speech got more views than any world leader’s on the official YouTube channel of the UN.

    Quoting the statistics of the UN Centre for Public Opinion Research, the Prime Minister’s Office (PMO) said that PM Shehbaz Sharif was watched by 1,370,000 viewers on the UN official channel.

    PMO further stated that on Al Jazeera’s TikTok account, PM Shehbaz Sharif’s address was watched by around 1.6 million viewers.

    During a hard-hitting address on Friday, Prime Minister Shehbaz Sharif slammed Israel at the United Nations (UN) General Assembly, highlighting the brutal assault on Gaza, the Ukraine conflict and India’s violent actions in occupied Kashmir.

    Founder Pakistan Tehreek-e-Insaf (PTI) Imran Khan, while showing intense anger over PTI leadership on ending the recent protests at Rawalpindi, has instructed to remove Chairman PTI Barrister Gohar Ali Khan from party chairmanship.

    Addressing PTI leaders at Adiala jail Rawalpindi, Khan questioned who decided to delay the PTI protest at Rawalpindi, upon which Azam Swati pointed fingers at Barrister Gohar, journalist Waseem Abbas told WE News.

    Journalist Mansoor Ali Khan, on his YouTube channel ‘Mansoor Ali Khan,’ reiterated the same news and added, “The news is not mainstreaming yet.”

    “Barrister Gohar Ali Khan buzdil admi hai usay farigh karain,” Imran Khan stated.

    While briefing Khan, Azam Swati said that people resisted till evening at the Rawalpindi protest, upon which former Prime Minister (PM) Imran Khan lambasted Swati and asked, “Have you come here to give explanations?”

    He also instructed PTI leaders to call for the protests next Friday at Islamabad D Chowk at every cost, no matter if it takes two days.

    “Agar CM KP Ali Amin Gandapur Liaqat bagh pohanch jata tu bara leader ban jata,” he concluded.

    Justice Munib Akhtar recuses himself from bench in Article 63A case

    The Supreme Court (SC) Justice Munib Akhtar has refused to join the five-member bench hearing the petition seeking a review of the previous apex court ruling on the defection clause under Article 63A of the Constitution.

    Chaired by Chief Justice of Pakistan (CJP) Qazi Faez Isa, the bench was supposed to comprise Justices Munib Akhtar, Aminuddin Khan, Jamal Khan Mandokhail, and Mazhar Alam Khan Miankhel.

    Following the absence of Justice Munib Akhtar, however, the bench did not hear the case on Monday.

    Justice Akhtar’s decision comes against the backdrop of his removal from the three-judge committee established under the Supreme Court (Practice and Procedure) Act 2023, after the promulgation of an amendment ordinance granting the CJP the authority to select any judge as the committee’s third member.

    Qazi Faez Isa stated that according to the Practice and Procedure Act, a three-member committee of the Supreme Court would again discuss and make a decision on the formation of a new bench if Justice Munib Akhtar does not join it.

    Earlier, after the amendments to the Practice and Procedure Act, CJP Qazi Faez Isa prioritised the fifth senior judge, Justice Aminuddin Khan, over the third senior judge, Justice Munib Akhtar, in the three-member committee.
