    Supreme Court ends lifetime disqualification

    In a landmark decision, the Supreme Court of Pakistan on Monday overturned the lifetime disqualification of lawmakers, rescinding its previous order that barred politicians from seeking office indefinitely.

    The decision came during the hearing of a case presented by former PML-N provincial member Sardar Meer Badshah Khan Qaisrani. The top court identified inconsistencies between the Election Act of 2017 and a previous Supreme Court ruling regarding the duration of disqualification.

    The Supreme Court declared that no person can be barred for a lifetime from running in elections if they are disqualified under Article 62 (1)(f), setting aside its landmark judgment in the Samiullah Baloch case.

    Sardar Meer Badshah Khan Qaisrani had filed a petition in 2007 challenging his lifetime disqualification over allegations related to a fake degree.

    Chief Justice of Pakistan, Qazi Faez Isa, announced that the Supreme Court aims to conclude proceedings on the lifetime disqualification case by January 4 (Thursday). This crucial decision will determine whether the amendment to the Election Act 2017 aligns with Article 62(1)(F) and establish whether lawmakers’ disqualification from contesting polls should be lifelong or limited to five years.

    The seven-member larger bench, led by Chief Justice Qazi Faez Isa and consisting of Justices Mansoor Ali Shah, Yahya Afridi, Aminuddin Khan, Jamal Mandokhail, Muhammad Ali Mazhar, and Musarrat Hilali, deliberated on the matter of lifetime disqualification for lawmakers during today’s proceedings.

    The apex court acknowledged the contradiction in the Election Act of 2017 and the earlier Supreme Court verdict and took this step after careful consideration. The decision marks a significant development in the ongoing debate over the length of disqualification for politicians and its alignment with constitutional provisions.

    Pakistan Muslim League-Nawaz (PML-N) candidates for the upcoming general elections hang in limbo as internal disagreements and seat adjustments cause delays in announcement of final ticket announcements, The News has reported on Monday.

    A source within PML-N told The News that it was expected that the party’s top leadership will award final party tickets on Sunday, however, the announcement got postponed due to seat adjustments with multiple political parties and internal disagreements between PML-N leaders.

    According to sources in the party, the matter of tickets is creating difficulties for aspirants who have yet to start their election campaigns.

    In Lahore, a rift between stalwarts Ayaz Sadiq and Sheikh Rohail Ashgar over party tickets has not been resolved, as both were not ready to give up. Similar is the case at Narowal, where Daniyal Aziz and Ahsan Iqbal are entangled in a rift over tickets for their blue-eyed candidates.

    PML-N leader Rohail Asghar said that he doesn’t know the destiny of the seat, but he enjoyed good relations with PML-N supremo Nawaz Sharif and has no disagreements with party leadership.

    No signal from ‘any quarters’ to postpone upcoming polls, Solangi confirms

    The federal Caretaker Minister for Information, Murtaza Solangi, stated on Friday that the interim government has not received any indication from any source to postpone the upcoming elections set to take place on February 8, 2024.

    Earlier on Friday, Senator Dilawar Khan tabled a resolution in the sparsely attended Upper House, which garnered the required support despite opposition from Information Minister Murtaza Solangi and Senator Afnan Ullah Khan of the Muslim League (N).

    Talking to journalists outside the Parliament House, Solangi said: “So far, no signal has been received from any quarters regarding the postponement of elections.”

    He also stated that only the Election Commission of Pakistan (ECP) has the authority to postpone general elections.

    The minister believed that there were no instructions from interim Prime Minister Anwaar-ul-Haq Kakar or the federal cabinet to postpone polls.

    According to Article 218(3) of the Constitution, ECPhas the power to conduct elections, give a date, or change the date for elections, he said.

    “We cannot interfere in the affairs of a constitutional body.”

    Former rivals Pakistan Muslim League-Nawaz (PML-N) and Pakistan Muslim League-Q (PML-Q) are expected to agree to seat adjustments for the upcoming general elections set to take place on February 8, 2024, as discussions on the matter between the two Punjab-based parties is in process, The News has reported.

    According to the report, PML-Q wanted seat adjustment on multiple seats in Punjab as well as on the seats where the party won in the 2018 polls. PML-Q won four National Assembly (NA) seats and eight provincial assembly seats in 2018.

    PML-Q leaders Salik Hussain, Monis Elahi, Hussain Elahi, and Tariq Bashir Cheema succeeded in those NA constituencies.

    PML-Q chief Chaudhry Shujaat’s son Shafay Hussain submitted nomination papers for two provincial assembly seats from the family stronghold of Gujrat.

    Sources claimed that seat adjustment is expected on Salik and Shafay Hussain’s seats.

    On the other hand, PML-Q leader Tariq Bashir Cheema will face PML-N’s Saud Majeed in Bahawalpur.

    However, discussion on the matter of seat adjustment between PML-N and the Istehkam-e-Pakistan Party (IPP) are still going on.

    Pakistan Muslim League-Nawaz (PML-N) Senior Vice President Maryam Nawaz owns assets worth more than Rs842.58 million, Geo News reported on Thursday.

    According to details submitted by Maryam Nawaz alongside her nomination papers, she owns 1500 kanal land in Lahore. Her assets increased by Rs4 million in one year.

    As per the submitted documents, Maryam Nawaz has a degree of masters in English literature. She doesn’t own a vehicle. She also has to give more than Rs 28.9 million to her brother Hassan Nawaz.

    The PML-N senior vice president also has Rs 10 million in different bank accounts, as well as shares worth Rs 12.2 million in different companies.

    The Election Commission of Pakistan (ECP) approved Maryam Nawaz’s papers from multiple constituencies in Lahore and Sargodha.

    The scion of the Sharif family had submitted nomination papers for two National Assembly constituencies—NA-119 and NA-120—and four Punjab Assembly constituencies—PP-159, PP-160, PP-165, and PP-80.

    Chief Justice of Pakistan, Qazi Faez Isa, has announced that the Supreme Court (SC) aims to finalise the proceedings on the lifetime disqualification case by January 4 (Thursday). This significant decision will determine whether the Election Act 2017 amendment aligns with Article 62(1)(F) and establishes whether lawmakers’ disqualification from contesting polls should be lifelong or limited to five years.

    The Supreme Court of Pakistan (SC) addressed the matter of lifetime disqualification of lawmakers today.

    A seven-member larger bench, headed by Chief Justice of Pakistan (CJP) Qazi Faez Isa, and comprising of Justice Mansoor Ali Shah, Justice Yahya Afridi, Justice Aminuddin Khan, Justice Jamal Mandokhail, Justice Muhammad Ali Mazhar, and Justice Musarrat Hilali.

    During the hearing of a case submitted by former PML-N provincial member Sardar Meer Badshah Khan Qaisrani last month, the top court noted discrepancies over the length of disqualification in the Election Act, 2017 and a Supreme Court ruling.

    The apex court noted that there is a contradiction regarding the duration of disqualification in the Election Act, 2017 and a SC verdict.

    In 2007, Meer Badshah Qaisrani filed a petition against his lifetime disqualification over a fake degree.

    The Election Commission of Pakistan (ECP) has officially communicated with the Pakistan Electronic Media Regulatory Authority (PEMRA), seeking strict action against media channels found violating the established code of conduct for the upcoming February 8 polls.

    The letter explicitly points out the airing of voting surveys by certain media channels. This practice, as per the ECP’s Code of Conduct for National Media, is prohibited under Clause 12.

    According to Clause 12, individuals working in print, electronic, and social media are prohibited from obstructing the election process and are required to display accreditation cards provided by the Election Commission.

    The ECP emphasized that both print and social media should refrain from conducting polls and surveys at polling stations or constituencies. The electoral watchdog stated that such activities have the potential to influence voters’ free choice and may disrupt the electoral process.

    The letter stated, “Given the seriousness of this issue, I am directed to state that PEMRA shall take prompt and appropriate action against the electronic media channels in strict alignment with Clause 12 of the Code of Conduct for National Media. A compliance report in this regard be also shared with this office as soon as possible for placing it before the Election Commission.”

    The ECP’s comprehensive 18-point code of conduct for media during elections includes provisions preventing the dissemination of content that reflects opinions prejudicial to the sovereignty, uprightness, or security of Pakistan. It also prohibits statements that could harm national solidarity or create a law and order situation.

    The regulatory framework extends to personal attacks on candidates or political parties in media content, mandating that any allegations should include comments from both sides. Monitoring responsibilities are delegated to Pemra, Pakistan Telecommunication Authority, Press Information Department, and the Cyber Wing and Digital Media Wing of the Ministry of Information and Broadcasting.

    The ECP further emphasized that these authorities are accountable for monitoring political parties’ and candidates’ coverage during election campaigns through electronic channels, print, and social media. Details of payments made by political parties and candidates must be submitted within 10 days after the poll day.

    The Election Commission of Pakistan warns that, in case of any violation of this Code of Conduct, it reserves the right to withdraw accreditation from individual journalists or media organizations. The authority to determine violations also rests with the electoral body. The media is also prohibited from airing unofficial results of a polling station until one hour after the close of the poll during the polling process coverage.

    Pakistan Muslim League-Nawaz (PML-N) senior leader Muhammad Zubair revealed on Sunday that his role in the party is limited now as the party doesn’t consult him while taking decisions.

    Acknowledging that country is heading towards the much-awaited general election, set to take place on February 8, 2024, Zubair said that he is in PML-N, “just like Abbasi.”

    The quote was in reference to former Prime Minister Shahid Khaqan Abbasi who is also at odds with the party. Ex-federal minister Miftah Ismail has also been sidelined.

    Muhammad Zubair said while speaking on the Geo News programme “Naya Pakistan” on Sunday, “I think, I am in the PML-N. I am in [the party] just like Abbasi is,” he added, as Abbasi had stepped down from the party office soon after the appointment of Maryam Nawaz as senior vice president and chief organiser.

    The PML-N leader also said that he supported the party with full energy from 2013 to 2018. “I stood firm with the party when a difficult time came in 2017 after the disqualification of Nawaz Sharif.”

    Pakistan Muslim League-Nawaz (PML-N) President Shehbaz Sharif announced plans to take part in the upcoming general elections from Karachi’s NA-242 constituencies, Geo News reported on Friday.

    In the last general elections, Shehbaz Sharif contested from NA-249 constituency of Karachi, but former Pakistan Thereek-e-Insaf (PTI) leader Faisal Vawda defeated him by a slim margin.

    However, Muttahida Qaumi Movement-Pakistan (MQM-P) announced on December 23 that no agreement had been reached for seat adjustments with the Pakistan Muslim League-Nawaz (PML-N) regarding the NA-242 constituency in the Kemari district.

    The party’s representative dismissed all claims about a seat arrangement with the Shehbaz Sharif-led party.

    The spokesperson added that MQM-P Senior Deputy Convenor Mustafa Kamal is the party’s candidate for the seat.

    Shehbaz Sharif said while addressing a press conference in Karachi that PML-N will resolve the issue of transport in Karachi after winning the election on February 8 next year.

    Pakistan Muslim League-Nawaz (PML-N) supremo Nawaz Sharif received clearance on Friday to take part in the upcoming general elections, set to take place on February 8, 2024, from the NA-15 (Mansehra-II) constituency, despite objections raised by Pakistan Tehreek-e-Insaf (PTI), as per The News.

    Hajra Sami, the Returning Officer (RO), rejected the objections raised by PTI leaders and declared the nomination papers of the former prime minister valid according to the rules of the Election Commission of Pakistan (ECP).

    “The scrutiny process of the nomination papers of PML-N supreme leader Nawaz Sharif has been completed, and all objections raised by PTI leader Azam Khan Swati and two others have been set aside, and he has been declared eligible to contest elections from here,” Jahangir Jadoon, the legal advisor to Nawaz Sharif, told reporters outside the RO offices.

    Sami reviewed the concerns raised by PTI senators Azam Khan Swati, Shahid Rafique, and Zakria Tariq in the presence of PML-N and PTI lawyers and leaders. After that, the RO gave clearance to Nawaz Sharif.

    The PTI legal team, headed by Waqar Khan Jehangira and Amir Shah, and the PML-N team, led by Jadoon, presented their arguments for two hours.

    “Nawaz Sharif is disqualified for holding any public office or contesting general elections by the Supreme Court’s five-member bench, so that he is not eligible to run in Feb 8, general elections from NA-15,” PTI’s counsel Waqar Khan Jehangiri told the RO during the proceedings.
