    Civilians to be tried in military court; Supreme Court decides

    The Supreme Court has, by a majority of 5-1, suspended its October 23 order that declared the trials of civilians in military courts null and void regarding the May 9 riots.

    The decision came in response to intra-court appeals (ICAs) filed by the federal and provincial governments, as well as the defense ministry, challenging the earlier verdict.

    A six-member bench of the Supreme Court, headed by Justice Sardar Tariq Masood and comprising Justice Aminuddin Khan, Justice Muhammad Ali Mazhar, Justice Syed Hasan Azhar Rizvi, Justice Musarrat Hilali, and Justice Irfan Saadat Khan heard the set of intra-court appeals.

    Justice Hilali differed with the majority decision.

    On October 23, a five-member apex court bench headed by Justice Ahsan unanimously admitted the pleas and nullified the government’s decision to try civilians in military courts in connection with the May 9 riots which erupted after the arrest of Pakistan Tehreek-e-Insaf (PTI)-then chairman Imran Khan.

    Four judges out of the five declared that Section 2(1)(d) of the Army Act and 59(4) (civil offences) are “ultra vires the Constitution and of no legal effect”.

    “Without prejudice to the generality of the foregoing the trials of civilians and accused persons, being around 103 persons […] shall be tried by criminal courts of competent jurisdiction established under the ordinary and/or special law of the land in relation to such offences of which they may stand accused,” the short order read.

    Following its verdict, the federal and the provincial governments along with the defence ministry filed intra-court appeals (ICAs). However, the caretaker government of Sindh refused to file any plea against the SC order.

    Justice Masood, who faced objections regarding his inclusion in the bench, refused to recuse himself.

    Former Chief Justice Jawwad S Khawaja and others had raised concerns about Justice Masood’s previous expressions on the matter, but the judge maintained his position.

    The Supreme Court’s recent decision to suspend the October 23 verdict means that the trials of 103 civilians will continue, with the final ruling conditional upon the Supreme Court’s subsequent orders.

    An anti-terrorism court has declared several leaders of the Pakistan Tehreek-i-Insaf (PTI) proclaimed offenders (POs) in three cases related to the May 9 riots.

    The decision was made by Judge Abher Gul Khan in response to separate applications filed by the investigating officers (IOs) of the cases.

    The IOs reported that despite strenuous efforts, the suspects, fearing arrest, had gone into hiding, making their apprehension challenging. Non-bailable arrest warrants had previously been issued against them, but the suspects failed to surrender to the law, prompting the police to request the court to declare them POs.

    Those declared POs in two cases of torching police vehicles near Jinnah House and Sher Pao Bridge are Hammad Azhar, Murad Saeed, Farrukh Habib, Azam Swati, Mian Aslam Iqbal, Hamid Raza, Karamat Khokhar, Khalid Gujjar, Sajjad Ahmad and Zubair Khan Niazi.

    In the third case, which pertains to burning the PML-N office in Model Town, Fawad Chaudhry, Hammad Azhar, Jamshed Iqbal Cheema and his wife Musarrat Cheema, Zubair Khan Niazi, Ghulam Abbas, Farhat Abbas and Hamid Raza had been declared POs.

    The judge also directed the IOs to submit details regarding moveable and immovable assets of the suspects so that proceedings for the attachment of their properties under section 88 of the Criminal Procedure Code (CrPC) could be started.

    It is noteworthy that several of these PTI leaders have already been declared POs in other cases related to the May 9 protests, including the attacks on Jinnah House and Askari Tower.

    Hamza Shehbaz wants an exemption

    In a separate legal development, an accountability court issued a notice to the National Accountability Bureau (NAB) on an application submitted by former chief minister Hamza Shehbaz. Hamza sought permanent exemption from personal appearance in the trial proceedings of the Ramzan Sugar Mills reference.

    Appearing before the court with his lawyer, Hamza Shehbaz’s application prompted the court to direct a NAB prosecutor to submit a reply by January 12. The NAB had reopened the reference, initially closed under defunct amendments to the National Accountability Ordinance 1999, following a Supreme Court decision that struck down those amendments.

    In the Ramzan Sugar Mills reference, NAB alleged that Shehbaz Sharif, then chief minister, and his son Hamza, in abetment and connivance, caused a loss of Rs213 million to the national exchequer by misusing their authority. The allegations revolve around the construction of a drain in Chiniot district primarily for the use of Ramzan Sugar Mills owned by Hamza and his brother Suleman.

    The Islamabad High Court (IHC) on Tuesday acquitted former prime minister and Pakistan Muslim League-Nawaz (PML-N) supremo Nawaz Sharif in the Al-Azizia reference, the biggest hurdle in the way of him contesting in the general elections.
    The only obstacle now for the former prime minister to contest an election is his lifetime disqualification as a parliamentarian.

    “It is unfortunate that if a former prime minister is facing such sham cases, then [we can’t imagine] what is happening to a common man,” senior lawyer Irfan Qadir told Geo News, calling upon the judges who convicted Nawaz to apologise to the nation.

    He also stated that, in response to the contentious Panama verdict, the Supreme Court had directed the National Accountability Bureau (NAB) to initiate legal proceedings against Nawaz by filing references.

    Pakistan People’s Party (PPP) co-chairman and former president of Pakistan Asif Ali Zardari has accused Jemima Goldsmith, the ex-wife of former Prime Minister Imran Khan, of paying vloggers while sitting abroad.

    In an interview on Aaj News with Asma Shirazi, the former president stated that a lobby with “multiple interests” has been funding and backing vloggers.

    The former president further added that it was a conspiracy to bring Pakistan Tehreek-e-Insaf’s (PTI) ex-Chairman Imran Khan into power, adding that some people wanted to extend his rule until 2035.

    “He [Khan] would have sold Pakistan, and the country would have defaulted if I had not ousted that person… Sometimes a puppet does not know what its handler is doing to it.”

    Asif Ali Zardari also said that “I can be a candidate for prime ministership and Bilawal too. Even Khursheed Shah can be the candidate.”

    On the other hand, PTI supporters are showing support to Jemima on X (previously Twitter), with #StayStrongJemimaKhan trending on the platform.

    Supreme Court approves live telecast of Zulfikar Ali Bhutto reference case

    The Supreme Court (SC) has approved a live telecast of a 12-year-old presidential reference regarding the contentious death sentence of former Prime Minister Zulfikar Ali Bhutto.

    On Monday, Pakistan People’s Party (PPP) Chairman and former foreign minister Bilawal Bhutto Zardari requested live broadcast of the hearing of the Zulfikar Ali Bhutto reference.

    The Chief Justice of Pakistan (CJP) Qazi Faez Isa is heading a nine-member, larger SC bench that is going to hear the 12-year-old presidential reference regarding the controversial death sentence awarded to the former prime minister.

    The decision to fix the case was made under Section 2(1) of the Supreme Court (Practice and Procedure) Act, 2023, by a three-member committee comprising CJP Isa, Justice Sardar Tariq Masood and Justice Ijazul Ahsan.

    Last week, the SC appointed a panel of two judges, Justice Athar Minallah and Justice Muhammad Ali Mazhar, to decide on the issue of the live broadcasting of 12-year-old presidential reference after former president Asif Ali Zardari the approached SC in 2011 to revisit the trial of the former prime minister.

    Previously, an 11-member apex court bench headed by Chief Justice Iftikhar Chaudhry conducted five hearings on the presidential reference. The last hearing in the said case was on November 11, 2022.

    Pakistan Muslim League-Nawaz (PML-N) supremo Nawaz Sharif repeated that he wants those who removed him as prime minister to be held accountable.

    “The country was thriving from 2013 to 2017 and the economy was better; however, good people were thrown out and Pakistan was handed to clumsy people,” said the PML-N chief while addressing the party’s parliamentary board meeting in Lahore.

    For the second consecutive day, the PML-N leader has emphasised the need for holding accountable those responsible for his removal since his return to the country in October, following a four-year self-imposed exile in London.

    The day before, when addressing PML-N ticket holders, he accused former generals and judges of filing baseless cases against him and causing harm to the country.

    Nawaz started his address today by expressing that, despite being physically distant, he remained deeply connected to the party members emotionally. He emphasised that he consistently kept his friends and companions in his thoughts.

    “During our time, the economy was better and development was at its peak. We still pray that the country is steered out of difficulties,” said the PML-N supremo.

    Former Army Chief willing to appear as witness in cipher case: The News

    Former army chief General (r) Qamar Javed Bajwa can surprise founder and former Pakistan Tehreek-e-Insaf (PTI) chief Imran Khan, as he is “willing to appear” as a witness in the cipher case, The News has reported.

    During the last hearing in cipher case, Imran Khan said while speaking to journalists, “I will include General Bajwa and US Embassy officials as witnesses in the case.”

    A source from The News confirmed that the former army chief also showed willingness to appear as a witness. However, he will require permission from military authorities.

    The former prime minister is currently in Adiala jail and facing charges under the Official Secrets Act, 1923. A special court is hearing the cipher case against Imran Khan and former foreign minister Shah Mahmood Qureshi.

    Imran had alleged that “General Bajwa did everything on Donald Lu’s directives”. 

    This accusation does not match the statements given by witnesses, including the former secretary of foreign affairs and Pakistan’s former ambassador to the US. Pakistan’s former ambassador to the US was in contact with Donald Lu, and their communication’s result was a cable that was sent to the foreign ministry, which is a normal thing.

    Imran Khan had also claimed that the cipher was a conspiracy against him to remove him from the office.

    The National Security Committee (NSC) deliberated over the cipher twice, once when Imran Khan was the prime minister of Pakistan and later in the tenure of Pakistan Muslim League-Nawaz (PML-N) president Shehbaz Sharif.

    The NSC found no evidence of conspiracy on both occasions against Imran Khan in the cipher.

    In a significant political development, Pakistan Muslim League-Nawaz (PML-N) head Nawaz Sharif visited Pakistan Muslim League-Quaid (PML-Q) President Chaudhry Shujaat Hussain at his residence after a gap of almost 15 years.

    According to the sources of Geo News, the meeting lasted for almost 40 minutes, with both leaders discussing the possibility of a political alliance for the upcoming general elections on February 8 next year.

    PML-N President Shehbaz Sharif and other leaders, including Maryam Nawaz, Rana Sanaullah, Ayaz Sadiq, and Azam Nazeer Tarar, also attended the huddle.

    PML-Q leaders Chaudhry Wajahat Hussain, Salik Hussain and Shafay Hussain were also in the meeting.

    The gathering occurs amidst heightened political engagement, with parties actively conducting election campaigns and forming electoral alliances to strengthen their position in the polls.

    Nawaz, a three-time former prime minister, came back to the country in October after nearly four years of exile in London. His return was aimed at energising his supporters in preparation for the elections.

    Earlier, the PML-N supremo succeeded in wooing electables from Balochistan to join his party ranks and also forged an electoral alliance with  Muttahida Qaumi Movement-Pakistan (MQM-P).

    Pakistan Electronic Media Regulatory Authority (PEMRA) has barred television channels from airing anything that casts doubt on the electoral process.

    The notification, issued on November 3, states, “All the satellite TV channel licensees were directed vide this office directives dated 3* November, 2023 to strictly comply with the PEMRA’s Code of Conduct 2015 and ensure that no speculative, doubtful and false information/content with reference to electoral process or conduct of General Elections is aired, broadcasted or televised in any manner, whatsoever, which may subsequently hamper smooth conduct of the General Elections 2024.”

    It further says that all the licensees, while airing their transmission before General Elections 2024, must be mindful of the fact that no such content/discussion / comment is aired which may create doubts or an impression in the minds of the public about the polls or may sabotage elections through any negative/false news, information or report aired on any satellite TV channel, inadvertently.

    Anchor Person Mohammad Malick took to X (former Twitter) and wrote, “Has Pemra gone absolutely bonkers? media barred from even discussing the possibility of flawed election process by EC. All media outlets & journo orgs must outrightly reject this ridiculous ‘unholy commandment’. this is brazen censorship and must be resisted.”

    Secretary General South Asian Free Media Association (SAFMA) Imtiaz Alam said, “Indeed, Election Commission of Pakistan should be respected, but it must earn respect by ensuring even-playing field fo all and transparently conducting electoral process. However, PEMRA order must be rejected. Media must critically evaluate the conduct of elections and ECP.”

    Former Prime Minister Imran Khan, currently under arrest, has said that he will ask the court to summon General (retd) Qamar Javed Bajwa, former Army Chief, in connection with the cipher case. Imran Khan shared this information during an informal conversation with journalists at Adiala Jail.

    Imran Khan explained the circumstances of his arrest, stating that it was all part of London’s plan. He drew a parallel with Nawaz Sharif, stating that after the London plan, Nawaz Sharif returned to Pakistan. He further claimed that Nawaz Sharif is responsible for 9 May incidents.

    Journalist Azaz Syed posted in a tweet that, “Imran Khan while talking to reporters in the jail (during the jail trial) said that I will summon Gen Bajwa to the court , he (Bajwa) did all on the directions of Donald Lu , I will also bring US Embassy officials and Gen Bajwa in doc (as witness).He said that Donald Lu took the cypher to Gen Bajwa, it was meant for Bajwa. “They wanted to remove me. They are trying to do with me what they did with Sheikh Mujib,” Imran reportedly said. He added that he can give in writing that his party will win the elections.

    Imran Khan, also the former Chairman of Pakistan Tehreek-e-Insaf (PTI), alleged that General Bajwa had acted on the instructions of US diplomat Donald Lu, asserting that he would ensure that General Bajwa faced the court for his actions.

    Responding to a question, Imran Khan emphasized that he had not engaged in any negotiations for a deal, declaring his readiness to submit a written statement affirming that PTI would emerge victorious in the elections.

    He further stated that he has faced no difficulties in jail and considers incarceration a form of worship.

    In response to queries about PTI leaders leaving the party, Imran Khan expressed gratitude for those departing, considering it a positive development.

    It’s important to note that a special court, established under the Secret Act, has set December 12 as the date to formally charge Imran Khan and Shah Mahmood Qureshi in the Safdar case. The case involves the alleged altercation with law enforcement at the Quaid’s mausoleum during Maryam Nawaz’s rally.

    Former prime minister Imran Khan has claimed that neither he met anyone in jail nor did somebody negotiate with him. He also stressed that the PTI will win the elections.

    Khan made these remarks while answering a reporter’s question, in his first interaction with the media since being imprisoned, about whether someone held negotiations with him.

    Recalling the events of May 9, the former PTI chairman said Dr Yasmin Rashid can be clearly seen asking people not to go inside the Lahore Corps Commander House. He added that CCTV footage could be seen to check who led the miscreants inside.  

    Furthermore, Khan said false accusations had been made through Khawar Maneka, adding that these were morally corrupt people. 

    “I can say on oath that I saw Bushra Bibi on the day of the marriage,” he insisted.

    Imran Khan said he wanted to convey a message that the “kaptaan” was ready to fight till his last breath. He further alleged that the so-called London Plan was meant to bring back PML-N supremo Nawaz Sharif, jail all PTI officials and finish the party.

    “I am making it clear to you today that the PTI will win the elections,” the former PTI chief said, adding that looking at the situation, it was feared they would run away from elections.

    He further commented on the economy, saying that growth has dropped from 6.17 to zero. “People are not mad; they know what these people have done.”

    On the other hand, Shah Mahmood Qureshi told a reporter he did not need any office within the party. The former minister was responding to a journalist’s statement that Barrister Gohar Ali Khan had been made the PTI chairman.

    “I stood by Khan yesterday; I am standing today and will continue to do so in the future,” Qureshi asserted. He added that he was at a stage where he did not need a position.

    He further urged the supporters of the former PTI chairman to go out of their houses and cast their votes. He added that he was in the hearts of Imran Khan and the people of the PTI.
