    Pakistan Tehreek-e-Insaf (PTI) followers have once again fallen victim to a fake video, presenting unknown travellers as children of former Chief Justice of Pakistan (CJP) Qazi Faez Isa.

     

    Sara Mir, also known as Rukhsana Kousar, a Pakistan Tehreek-e-Insaf (PTI) worker yesterday misled PTI followers by adding a voice-over over the original video, falsely identifying unknown travellers as former Chief Justice Pakistan Qazi Faez Isa’s sons arriving at London airport.

     

     

    In the original video, it can be seen that a social media user, reportedly named Jamil, asked the unknown travellers, “Are they Qazi Faez Isa’s son? Upon which, an individual said, “No, no, they are not these children,” and the video gets cut.

    Sara Mir added her voiceover in the original video in which she used harsh language against the unknown travellers, declaring them to be Qazi Faez Isa’s children.

    “Qazi Faez Isa has sent his son here. Look at Qazi’s shameful and filthy son,” Sara Mir said in the dubbed video.

    Netizens unhappy with remarks by outgoing CJP Qazi Faez Isa

    As the outgoing Chief Justice of Pakistan (CJP) Qazi Faez Isa visited the monuments of the Supreme Court on October 25, he was surrounded by a plethora of reporters when he remarked: “You should be thankful to live in a country where you can say these things.”

    Netizens, however, are not happy with the former CJP’s statement, calling it “problematic and highly condemnable.” In a Reddit post, a user posted the link to journalist Matiullah Jan’s recent video in which the former CJP could be seen walking around outside the Supreme Court yesterday when he passed these remarks in answer to journalists’ constant questions.

    “Why does a now former chief justice find a problem when journalists ask valid questions? What did he mean by that? Even on his last day as a judge, he passes thug comments. How deplorable!” wrote the user in its post.

    Another Reddit user commented: “He could have retired with grace and dignity. He sold his soul to the highest bidder and will face the consequence of his own actions.”

    While another user commented: “Matiullah does know “Warna Kiya”. He faced contempt of court by a three member SC bench for tweets criticizing judges during Faez Isa case no less. Faez Isa wasn’t as trigger happy to use contempt as previous judges were.”

    It should be noted that Supreme Court judges have been surrounded by infighting and controversy, especially regarding the government’s successful passing of the 26th Amendment, which was aimed at judicial reforms.

    For instance, Justice Mansoor Ali Shah refused to attend Friday’s full court reference in honour of the outgoing Chief Justice of Pakistan (CJP), Qazi Faez Isa.

    The senior puisne judge Syed Mansoor Ali Shah, in a letter of refusal on the record of the reference proceedings, alleged that CJP Isa had not upheld the integrity of the judiciary during his tenure.

    Full court reference is a long-standing tradition in legal systems and a ceremonial acknowledgement of the outgoing Chief Justice’s contributions and services to the judiciary, leadership and dedication to upholding the judiciary integrity.

    In the strongly critical letter, Shah wrote: “To stand a Reference and celebrate such a tenure would send a message that a Chief Justice can betray his institution, erode its strength, act petty and low and still be celebrated as an honorable servant of justice. I am sorry, I in good conscience, cannot stand at a reference for such a Chief Justice.”

    Syed Mansoor Ali Shah added, “Chief Justice Qazi Faez Isa, like an ostrich, with his head in the sand, remained complacent and indifferent to external influences and pressure on the judiciary.”

    “His tenure will be defined by pettiness, vindictiveness, and a lowly approach to administrative matters, having no grace or humility,” he said to Qazi Faez Isa while concluding in a letter.

    On Thursday night, Justice Munib Akhtar, Justice Athar Minallah, Justice Ayesha Malik, and Justice Shahid Waheed, along with Justice Syed Mansoor Ali Shah, remained absent at the reception of Qazi Faez Isa.

    Chief Justice Pakistan Qazi Faez Isa apologised for reaching late at his farewell dinner ceremony on Thursday night, saying that he came late because “I went for a haircut.”

    “I usually have a habit of arriving early, but Justice Naeem Akhtar Afghan suggested that I should get a haircut before attending the event. When I went to get the haircut, a young man was getting a facial, which resulted in a delay,” Qazi Faez Isa stated while addressing the farewell dinner.

    The farewell dinner was hosted by the Supreme Court Bar Association (SCBA) and the Pakistan Bar Council (PBC) on Thursday night.

    Qazi Faez Isa further remarked that he had been working since 1982 and used to take leaves for months, but it had been a while since he had taken off.

    Meanwhile, during the full court reference to honour CJP Qazi Faez Isa today, the court witnessed his last laugh as the head of the Apex Court when Justice Yahya Afridi humorously narrated the expenses of the farewell lunch.

    “Now to my commitment, sir, this is the formal announcement that the farewell lunch today is not at government expense; he is being cruel and imposed the entire expenses on me; however, I requested my brother judges to share the brunt,” Yahya Afridi claimed, and court attendees burst into laughter.

    “He was adamant and stubborn and was in no mood to accept farewell lunch on government expenses; he agreed only when we committed the expenses,” Justice Yahya announced.

    Qazi Faez Isa is retiring today, and Justice Yahya Afridi, third on the seniority list, will take the oath of Chief Justice of Pakistan on Saturday (tomorrow).

    Five Supreme Court judges have skipped Chief Justice Pakistan (CJP) Qazi Faez Isa’s farewell reception, including senior puisne Justice Syed Mansoor Ali Shah.

    The Supreme Court Bar Association (SCBA) and the Pakistan Bar Council (PBC) hosted the dinner on Thursday night on the eve of CJP Isa’s retirement on October 25.

    Justice Munib Akhtar, Justice Athar Minallah, Justice Ayesha Malik, and Justice Shahid Waheed, along with Justice Syed Mansoor Ali Shah, remain absent at the reception of Qazi Faez Isa.

    However, Justice Yahya Khan Afridi, Justice Musarrat Hilali, Justice Naeem Akhtar Afghan, Justice Jamal Mandokhail, Justice Aminuddin Khan, Justice Aqeel Abbasi, Justice Muhammad Ali Mazhar, Justice Irfan Saadat Khan and Justice Shahid Bilal Hassan attended the dinner.

    Chief Justice of Lahore High Court (LHC) and Islamabad High Court (IHC) were also among the attendees of Chief Justice Pakistan’s reception.

    Justice Mansoor Ali Shah has gone for Umrah along with his family on Wednesday. He was all ready to become the next Chief Justice of Pakistan before the passing of the 26th Constitutional Amendment.

    A Special Parliamentary Committee nominated the third senior most judge in the Supreme Court, Yahya Afridi, as the next CJP, and he will take the oath on October 26 (tomorrow).

    As per Dawn News, the next Chief Justice, Yahya Afridi, at his expense, will hold the luncheon in honour of Qazi Faez Isa today (Friday), as CJP Isa had declined the farewell meal at government expense.

    Chairman Pakistan Peoples Party (PPP) Bilawal Bhutto Zardari praised Chief Justice Pakistan (CJP) Qazi Faez Isa over his verdicts on risky cases in the past.

    Speaking at a PPP rally in Hyderabad held to mark the 17th anniversary of the Karsaz incident, Bilawal Bhutto Zardari, in a roaring tone, remarked that Qazi Faez Isa delivered a brave judgement on the Faizabad Dharna case, which no other judge had the courage to deliver.

    “History will remember you (Qazi Faez Isa) for declaring former dictator General Musharraf a traitor and showing courage in calling Musharraf a dictator,” the former Foreign Minister stated.

    “The nation salutes you,” he added.

    Responding to the political parties’ lack of consensus on the 26th Constitutional Amendment in parliament, Bhutto said that he would be forced to push the Constitutional Amendments through parliament using a “brute majority” to break the ‘one unit’ system in the judiciary.

    “It is my desire to have consensus among all political parties in parliament for this amendment. The second option, which is not my preferred path, is to rely on the majority’s vote to pass it,” he maintained.

    However, the incumbent government is reportedly short of 13 votes in the National Assembly (Lower House) and nine in the Senate (Upper House) to pass the Constitutional amendments.

    The Chief Justice of Pakistan (CJP) Qazi Faez Isa has declined a farewell dinner, a tradition for every outgoing Chief Justice, saying that he cannot accept the event because it will cost approximately “two million rupees” funded by public money.

    As per the tradition, the Supreme Court’s registrar’s office sent a note to the Chief Justice regarding the reception planned for his retirement on October 25.

    The CJP underscored that such an event in his honour was unnecessary, making this the first time in the Supreme Court’s history that no farewell reception has been held for a retiring judge.

    Justice Syed Mansoor Ali Shah, the next senior judge, will become the next Chief Justice, although the government has yet to notify him.

    A full court reference has also been scheduled for October 25, where Chief Justice Qazi Faez Isa will officially step down, according to an official letter issued by the court’s registrar to Supreme Court Bar Association President Shahzad Shaukat yesterday.

    Supreme Court overturns 2022 verdict on Article 63A

    A larger five-member bench, headed by Chief Justice Pakistan (CJP) Qazi Faez Isa, has accepted the review petition of Article 63A filed by the Supreme Court Bar Association (SCBA).

    The ruling given in May 2022 by a five-member larger bench headed by former CJ Umar Ata Bandial on Article 63A has been struck down by the apex court’s larger bench with a 5-0 majority.

    Chief Justice of Pakistan Qazi Faez Isa stated that Article 63A is redundant as the constitution already addresses the issue clearly, and added that judges can’t write the constitution.

    The five-member bench included Justice Aminuddin Khan, Justice Jamal Khan Mandokhail, Justice Naeem Akhtar Afghan, and Justice Mazhar Alam Miankhail, along with CJP Qazi Faez Isa.

    A recent top court five member bench verdict by 3-2 stated that parliament members who vote against their parliamentary leader will be considered deviant, and their vote will also be not counted.

    It should be mentioned here that the verdict of May 17, 2022 was authored by Justice Munib Akhtar.

    However, the detailed review case verdict of Article 63A will be issued soon.

    Article 63A noted that parliamentary members will lose their seats if they vote against the command of the party chief.

    However, it is not stated that parliamentary vote can’t be counted.

    During the hearing, Qazi Faez Isa stated that political parties are not subject to the authority of a judge or Chief Justice.

    Counsel of founder Imran Khan of Pakistan Tehreek-e-Insaf (PTI), Barrister Ali Zafar, objected to the composition of the bench on behalf of his client. As a result, the Supreme Court appointed him as judicial assistant.

    Barrister Ali Zafar told the members of the larger bench that the parliamentary party directed the parliament members to vote in parliament and added that the Chief Parliamentary party could send ineligible references to parliamentary members if his order defied.

    In response, the Chief Justice declared the vote against the party “a suicide attack.”

    Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan, has lashed out at the Chief Justice of Pakistan (CJP) Qazi Faez Isa, questioning his mental stability during a conversation with journalists on Friday.

    “No Chief Justice in the world has acted the way Pakistan’s Chief Justice is behaving. He does not seem mentally sound to me,” exclaimed Khan, accusing the CJP of biased behaviour.

    He also criticised the January 2024 Supreme Court ruling stripping the PTI of its electoral symbol ‘bat’ calling it biased because the “the SC verdict in the reserved seats case has vindicated our stance.”

    The former Prime Minister further alleged that the CJP was involved in “election fraud” and was trying to punish PTI for extending his tenure.

    “The so-called third umpire also seeks an extension, and for that, they need PDM’s support. They are destroying democracy and the rule of law to maintain power while the nation begs for a single dollar,” stated Khan.

    Founder Pakistan Tehreek-e-Insaf (PTI) Imran Khan has announced that the party will hold a protest for judicial independence on the coming Thursday.

    Speaking to journalists in Adiala jail Rawalpindi, he stated, “We have our own protest on Friday and will hold a rally in Rawalpindi on Saturday. We will protest if it is not allowed.”

    Lambasting the incumbent government, Imran Khan said that the country has become a police state and declared that this “martial law” is even tougher than that of former dictators General Zia Ul Haq and General Parvez Musharraf.

    Talking about the Practice and Procedure Amendment Act, he said, “Now everything has been exposed and veils removed. The Practice and Procedure Act was aimed at hearing cases in an undemocratic manner.”

    Meanwhile, Chief Minister (CM) Khyber Pakhtunkhwa (KP) Ali Amin Gandapur met Imran Khan in Adiala jail.

    Senior lawyers urge Justice Qazi Faez Isa to resign on Oct 25

    Senior lawyers, including the president of the Supreme Court Bar Association (SCBA), have strongly opposed the secretive constitutional package proposed by the government and called upon Chief Justice of Pakistan Qazi Faez Isa to hang his robes with honour on October 25, 2024.

    In a letter signed by senior advocates Muneer A. Malik and Faisal Siddiqi, lawyers stressed that Justice Syed Mansoor Ali Shah will deservedly be the next CJP on the dawn of October 26.

    In the letter, they also urged Justice Isa to “preserve his legacy and not be a nominee for any appointment for any proposed constitutional bench.”

    Both senior advocates recalled that they had acted as legal counsels or supported Justice Isa through their writings against the “unconstitutional and mala fide presidential reference filed against the then Justice Qazi Faez Isa” in 2019.

    SCBA president Shehzad Shaukat cautioned against the secrecy with which the coalition government was trying to pass the supposed amendments and not bringing it to designated forums for open discussion.

    Shaukat pointed out that the SCBA is unlikely to oppose the proposed amendment if it relates to the creation of a constitutional court, which, according to him, is necessary for dispensing justice to common people because the Supreme Court is mostly busy hearing cases of a political nature.
