    Detained Iran protesters raped, sexually assaulted: Amnesty

    Members of the Iranian security forces raped and used other forms of sexual violence against women and men detained in the crackdown on nationwide protests that erupted from September 2022, Amnesty International said Wednesday.

    Amnesty said in a report it had documented 45 such cases of rape, gang rape or sexual violence against protesters. With cases in more than half of Iran’s provinces, it expressed fear these documented violations appeared part of a “wider pattern.”

    “Our research exposes how intelligence and security agents in Iran used rape and other sexual violence to torture, punish and inflict lasting physical and psychological damage on protesters, including children as young as 12,” Amnesty’s secretary general Agnes Callamard said.

    The London-based organization said it had shared its findings with the Iranian authorities on November 24 “but has thus far received no response.”
    The protests began in Iran in September 2022 after the death in police custody of Mahsa Amini, 22. Her family says she was killed by a blow to the head but this has always been disputed by the Iranian authorities.

    After rattling Iran’s clerical leadership, the movement lost momentum by the end of that year in the face of a fierce crackdown that left hundreds dead, according to rights activists, and thousands arrested, according to the United Nations.

    Amnesty said 16 of the 45 cases documented in the report were of rape, including six women, seven men, a 14-year-old girl, and two boys aged 16 and 17.

    Six of them — four women and two men — were gang raped by up to 10 male agents, it said.

    It said the sexual assaults were carried out by members of the Revolutionary Guards, the paramilitary Basij force, agents of the intelligence ministry, as well as police officers.

    The rapes on women and men were carried out with “wooden and metal batons, glass bottles, hosepipes, and/or agents’ sexual organs and fingers,” it said.

    As well as the 16 rape victims, Amnesty said it documented the cases of 29 victims of other forms of sexual violence such as the beating of breasts and genitals, enforced nudity, and inserting needles or applying ice to men’s testicles.

    It said it collected the testimony through interviews with the victims and other witnesses, conducted remotely via secure communications platforms.

    “The harrowing testimonies we collected point to a wider pattern in the use of sexual violence as a key weapon in the Iranian authorities’ armory of repression of the protests and suppression of dissent to cling to power at all costs,” said Callamard.

    One woman, named only as Maryam, who was arrested and held for two months after removing her headscarf in a protest, told Amnesty she was raped by two agents during an interrogation.

    “He (the interrogator) called two others to come in and told them ‘It’s time’. They started ripping my clothes. I was screaming and begging them to stop.

    “They violently raped me in my vagina with their sexual organs and raped me anally with a drink bottle. Even animals don’t do these things,” she was quoted by the group as saying.

    A man named as Farzad told Amnesty that plain clothes agents gang raped him and another male protester, Shahed, while they were inside a vehicle.

    “They pulled down my trousers and raped me. I couldn’t scream out. I was really being ripped apart… I was throwing up a lot, and was bleeding from my rectum when I went to the toilet,” said Farzad who was released without charge a few days later.

    Amnesty said most victims did not file complaints against the assault for fear of further consequences, and those who did tell prosecutors were ignored.

    “With no prospects for justice domestically, the international community has a duty to stand with the survivors and pursue justice,” said Callamard.

    Sindh’s caretaker Minister of Law and Human Rights, Muhammad Umar Sumro, confirmed that DNA samples collected from Pir Asad Shah, the prime suspect in Fatima murder case, have matched with the semen traces found on the victim’s clothing.

    He was addressing the National Judicial Conference at a local hotel in Karachi.

    On August 14, ten-year-old Fatima Pharriro was brutally subjected to physical and sexual violence, allegedly by Pir Asad Shah and his wife Hina Shah, and was found dead at their haveli in Ranipur.

    A case was lodged on the complaint of her mother, Shabnam Khatoon, under Sections 302 (intentional murder) and 34 (acts done by several persons in furtherance of a common intention) of the Pakistan Penal Code (PPC) at Ranipur police station and an investigation was initiated.

    The minister further highlighted that DNA samples initially did not yield a match due to the alleged tampering of evidence by officials of the health department, reportedly under the influence of the suspect.

    A breakthrough occurred when the samples were sent to a facility in Punjab for processing, and the subsequent analysis established a clear match between the DNA obtained from the suspect and the samples found on the victim’s clothes.

    According to an earlier DNA report from the Liaquat University of Medical and Health Sciences in Jamshoro, the examination of the semen stains on the deceased girl’s clothing had revealed “mixed DNA profiles,” providing crucial evidence in the ongoing investigation of this tragic case.

    Court Updates

    On November 8, all suspects were produced by jail authorities, and the final charge sheet was submitted by the investigation officer. for the charge frame.

    According to the final challan report, the DNA report has not been submitted to the court yet.

    The DNA report has been submitted to Police Surgeon Karachi, as per the final post-mortem report, the supplementary post-mortem report will be submitted after the DNA report.

    Therefore, after receiving the supplementary post-mortem report, it will be produced.

    Fatima’s case
    A domestic maid, 10-year-old child Fatima Phuriro, was found dead under suspicious circumstances in Ranipur.

    The child had been working as a domestic worker at a haveli owned by an influential local, Pir Asad Shah Jilani.

    Fatima’s mother, Shabana, was informed about the death by the employer who asked her to remove the body from the premises.

    According to DIG Sukkur Javed Jiskani, the parents initially did not share the facts of the case with the police and claimed that the girl was suffering from gastroenteritis.

    While her diagnosis was also confirmed by Dr Abdul Fatah Memon who treated her, the DIG revealed that Fatima was taken to the hospital either by the Pir or his staff and that the SHO was present at the time she was pronounced dead.

    It was not until videos of the child were leaked by an unknown source and circulated on social media that the case caught the media’s eye. By then, the family had buried Fatima on August 15.

    The body was later exhumed and sent for an autopsy which revealed that the girl had been raped both vaginally and anally.

    The Model Court for Sexual Violence in Lahore has awarded death sentence to Rafiq for raping his 14-year-old daughter.

    The verdict was read out by Judge Mian Shahid Javed. The court also ordered that the father should also pay Rs 10 lakh as compensation to the daughter, adding that in case of non-payment, the criminal will have to undergo another six months of imprisonment.

    The court directed the jail superintendent not to carry out the death sentence until confirmation from High Court.

    A case was registered against Rafiq back in in March 2019 by Satwa Katla police station.

    There are fears of further delay in 10-year-old Fatima’s case as police officers working on the child’s mysterious death have been reappointed.

    Currently, the new SSP Khairpur, Samiullah Soomro, has taken charge of his post.

    Pir Asad Shah, the main suspect, and compounder Imtiaz Merasi, are on physical remand while accused Hina Shah and her father could not be arrested.

    Police say that Asad Shah’s recovered DNA samples have been sent to Lahore, adding that it will take more time to receive relevant reports.

    According to police sources, the final post-mortem report of the girl has not been received yet.

    Hollywood stars Ashton Kutcher and Mila Kunis were among the 50 people writing letters in favor of actor Danny Masterson, who has been sentenced to 30 years in prison after being found guilty of raping two women in 2003. The husband -wife duo had worked with Masterson for the sitcom “The ’70’s show” which ran from 1998 till 2006.

    In his letter, Ashton Kutcher wrote about Masterson being a ‘role model’:

    “While I’m aware that the judgement has been cast as guilty on two counts of rape by force and the victims have a great desire for justice, I hope that my testament to his character is taken into consideration in sentencing. I do not believe he is an ongoing harm to society and having his daughter raised without a present father would [be] a tertiary injustice in and of itself. Thank you for taking the time to read this.”

    While Mila Kunis commented on Danny’s drug-free lifestyle, prosecutors said Danny had drugged the two women in his Hollywood Hills home and raped them.

    “One of the most remarkable aspects of Danny’s character is his unwavering commitment to discouraging the use of drugs. His influence on my in this regard has been invaluable. In an industry where the pressures and temptations of substance use can be overwhelming, Danny played a pivotal role in guiding me away from such destructive paths. His dedication to avoiding all substances has inspired not only me but also countless others in our circle. Danny’s steadfastness in promoting a drug-free lifestyle has been a guiding light in my journey through the entertainment world and has helped me prioritize my well-being and focus on make responsible choices.”

    At the sentencing, the two women Danny was convicted of raping in 2003, spoke about the trauma the ordeal had inflicted upon them:

    “When you raped me, you stole from me,” said Jane Doe 1 “That’s what rape is, a theft of the spirit.”

    “You are pathetic, disturbed and completely violent. The world is better off with you in prison.”

    Jane Doe 2 spoke about how Danny “had not shown an ounce of remorse for the pain he caused.” She told the judge, “I knew he belonged behind bars for the safety of all the women he came into contact with. I am so sorry, and I’m so upset. I wish I’d reported him sooner to the police.”

    At the trial held on Thursday morning in Los Angeles, Judge Charlaine Olmedo gave a speech before sentencing Masterson to 30 years in prison:

    “I know that you’re sitting here steadfast in your claims of innocence, and thus no doubt feeling victimized by a justice system that has failed you. But Mr. Masterson, you are not the victim here. Your actions 20 years ago took away another person’s voice, and choice. One way or another you will have to come to terms with your prior actions, and their consequences.”

    According to The News, War Against Rape (WAR), an advocacy organisation, published a report based on data taken from Punjab Home Department and Ministry of Human Rights which reveals that 21,900 women were raped in the province between 2017 and 2021. This indicates that an average of 12 women were raped daily or one woman assaulted every two hours.

    However, as per the organisation, this number is only representative of a small portion as many cases are not reported due to stigma, fear, victim-blaming, and systemic biases in the justice system.

    18 per cent of women are subjected to early and forced marriages. There are about 19 million child brides at the moment. Sindh has legalised marriage for boys and girls at 18 while other provinces have set the age for girls at 16.

    Karachi
    As per the police surgeon’s office in Karachi, there were 3,649 cases of domestic violence reported in 2022.

    WAR team investigated 66 cases of different forms of sexual violence from July 2022 to June 2023.

    The News highlighted statistics from the report: 44 survivors were children under 18 years with the most vulnerable age group being 4-11 years; the average age of survivors was only 13 years, with the youngest survivor being mere four years old; and of these cases, 85 per cent involved women and female children.
    A total of 35 of the 66 cases were of rape, 11 were gang rape cases, another 11 were attempted rapes, and nine involved incest.

    Additionally, in 10 cases, boys were also victims while 12 children were murdered after being subjected to sexual violence, including nine girls and three boys.

    Korangi has been deemed a red alert zone as it has the highest sexual violence cases with 31 per cent, followed closely by Surjani Town with 30 per cent of reported cases.

    The Saeedabad area reported 11 per cent of the cases, Iqbal Market nine per cent, Orangi Town seven per cent, Mehmoodabad six per cent and Gulshan-e-Iqbal reported five per cent of the cases of sexual violence.

    Cases underreported
    The official data from three major public hospitals of Karachi revealed the conduction of 1,256 medico-legal examinations (MLEs) in sexual assault cases from January 2021 to December 2022 whereas only 499 first information reports (FIRs) were filed in this same duration.

    WAR report stated: “This underscores the urgent need for improved mechanisms to encourage survivors to report incidents. In the first six months of 2023, Pakistan witnessed a harrowing increase in child sexual abuse cases, with an average of 12 children sexually abused daily, totalling 2,227 cases. The comparison with 2021-22 data shows a disturbing upward trend in child sexual abuse cases.”

    Workplace harassment
    The News highlights that the Federal Ombudsman Secretariat for Protection Against Harassment (FOSPAH) reveals that more than 2,000 complaints were filed between 2018 and 2022 in the government sector and around 1,400 cases in the private sector, involving both men and women.

    “Due to harassment, a large number of complainants end up leaving their jobs or normalising the harassment and hostile work environment. This discourages women from entering the workforce and restricts them from reaching financial independence”

    A case has been registered against feudal lord, Ali Raza Arain by the Model Town police in Burewala, Punjab, for raping his maid for several months, then forcing her to get an abortion when she got pregnant. According to Express Tribune, Arain raped his maid on gunpoint, recording a video of the act. He allegedly continued to rape her for several months, blackmailing her by threatening to upload the video on social media.

    In the First Information Report (FIR), the survivor said she got pregnant after several months of repeated sexual torture. She was then forced to get an abortion. The survivor filed a case with the Model Town police after which an FIR was registered against Arain.

    The news follows a string of cases of househelpers being abused and tortured by their employees. On July 25, Rizwana, a child domestic helper was beaten by Somia Asim, the wife of a civil judge. In her official statement given to the police on August 18, the survivor recounted how she was beaten with sticks, iron rods and other objects.

    In Sindh, the case of a 10-year-old domestic maid, Fatima, grabbed headlines when the child was found dead at the home of a spiritual pir. An autopsy conducted after exhumation of the child’s body showed extensive proof of rape and beatings. Pir Asad Ali Shah, the main suspect, remains in police custody.

    Average 12 children sexually abused daily, new report says

    Sahil, a non-profit organization working for the rights of children in Pakistan, has published a new report, “Six Months Cruel Numbers 2023”, revealing cases of sexual violence reported in the first half of 2023.

    A total of 2,227 children have been subjected to sexual violence from January to June this year alone. This means that on an average, 12 kids have suffered sexual violence every day in these months.

    The source for Sahil’s data are media reports; the actual number of cases might be higher considering all cases are not documented.
    1,207 of the cases are of girls — more than half, 54 percent. While 1,020 of the cases are of boys. In the same period in 2022, the number of girls encountering abuse was the same as 2023, while cases involving boys have risen.

    Age bracket:

    The most vulnerable to abuse are in the age group of 6-15 years, in which more boys than girls were victimised. This age bracket makes up 47 percent of the total cases recorded — 593 boys and 457 girls.

    Types of cases:

    Cases of abduction are still the most prevalent with 44 per cent, 13 per cent cases of sodomy, 10 per cent of cases of rape and nine per cent of cases of missing children were reported.

    53 cases of pornography have also been reported that are being tracked by the Federal Investigation Agency on the dark web. As per the report, 72 per cent of victims were boys and 28 per cent of victims were girls

    Abusers:

    2,531 abusers have been involved in child abuse in the first six months of 2023. In most cases, they were acquainted or related to the victims or their families.

    The abusers were acquaintances in 912 cases, strangers in 498 cases, and both in 215 cases.

    Location:

    According to the report, between January and June, the crime was committed at the “abuser’s place because the abusers trap innocent children and take them to their places”.

    However, in most cases, the place of abuse remained unknown with 31 per cent committed in the streets, 11 per cent at victims’ place, four per cent in fields, and two percent at places of worship.

    45 per cent cases were reported from rural areas and 55 per cent from urban areas.

    As per provincial breakdown, the highest number of cases, 74 per cent, were reported from Punjab, followed by 14 per cent from Sindh, seven per cent from Islamabad, three per cent from Khyber Pakhtunkhwa and two per cent from Balochistan, Azad Jammu and Kashmir and Gilgit Baltistan.

    88 per cent of all the cases were registered with police while 25 cases were either not filed or police refused to register them.

    Violence against children:

    Sahil also reveal that a total number of 963 cases of accident and/or violence were allegedly reported against the children among who 760 died: 268 drowned, 148 murdered, 144 accidents and 61 children committed suicide.

    Highest number reported were from Sindh with 483 cases followed by Punjab in second place with 233 cases.

    Update: According to the police, the man who was arrested for harassing actress Srha Asghar has walked free while the FIR against him will be dismissed due to non-cooperation of the complainant.

    Geo News reports that Inspector Javed Babar has said that when the harasser was produced in court on Friday, he denied the allegations. The actress was summoned to appear in court by the female judge, but she didnt arrive, nor was any evidence of the incident produced.

    “Even the clothes torn during the incident or eyewitnesses of the incident requested by the police and the court were not produced,” he said.

    TRIGGER WARNING: discussion of harassment

    In a horrifying case, actress Srha Asghar reportedly filed a First Information Report (FIR) against a man, Asim, when he allegedly tried sexually assaulting her outside her home in Karachi. The FIR was registered at Shah Faisal Police Station on the complaint of Srha’s husband, Umar Murtaza.

    According to Police officials, the incident took place in August when the actress left her house to go to the nearby market to get groceries. A man kept following her back home and cat-called her. Asghar’s statement further revealed the man tried groping her which resulted in her clothes getting torn.

    The actress then rung the doorbell after which her husband came outside, which led to a fight between him and the assaulter. After which, the assaulter was taken to the police station by Umar and their neighbors.

    Srha and her husband have refused to give comments to media, but the actress did post a note on her Instagram stories where she slammed media organisations for including personal information on their news to get ratings, telling them to stop calling her:

    “I want every media person to stop messaging me about the incident, shame on them for calling me and my husband continuously for an interview for your ratings! And shame on the news channel who attached all the personal info with the incident! We ae safe Alhumdulillah!”

    Sindh High Court (SHC) on Monday rejected a suspect’s plea for pre-arrest bail in a case pertaining to the murder of his teenaged wife.

    He was handed over to the police.

    In an Instagram post, Pakistani civil rights activist and lawyer Mohammad Jibran Nasir shared that the suspect Hassan is finally in police custody almost a year after brutally murdering 19-year-old Hifza. The suspect strangled his wife and then hung her body by the ceiling fan to make it look like suicide.

    Nasir further stated that two days before her murder, Hifza on a recorded phone call, complained to her brother-in-law about being subjected to sexual violence, beatings and abuse by the suspect.

    The suspect runs a madrassah, along with his father who is co-accused in the murder case. The lawyer pinpointed that they lived in the upper portion of the madrassah where the murder was committed.

    Nasir admired the efforts made by the victim’s mother Farzana, saying it was her struggle for justice that led to the culprit’s arrest.

    In the video posted by him, police can be seen taking the suspect away while the mother of the victim tells him that he is an imposter not a mullah, “I had married my daughter to you because of your religious status, but you are a phony.” In response, the suspect threatened her that “You will be next.”
