  • Shahzeb won’t get justice: the fault in our laws

Shahzeb won’t get justice: the fault in our laws

The Supreme Court acquitted Shahrukh Jatoi as well as his accomplices in the Shahzeb Khan murder case. Jatoi, a scion of a rich and influential family, has gotten away with murder, which is a prime example of a miscarriage of justice. Ten years ago, Jatoi and his friends killed 20-year-old Shahzeb Khan. Jatoi also flew out of the country to escape the law. He was eventually brought back. Later, Shahzeb’s family pardoned him as they faced threats. Not many can forget how the 20-year-old was shot dead for trying to stop Jatoi and company from harassing his sister, and also the way the system protected them. Although the victim’s father was a senior police officer, the police would not register an FIR against the accused.

In this particular case, we should not forget the role of the Sindh government that consistently facilitated Shahrukh Jatoi because of his influential father. And now our superior judiciary has set him free. Imagine what must be going through the minds of Shahzeb’s family members who not only lost a young loved one but will not have to deal with the trauma of seeing Shahzeb’s murderer being set free. The justice system has indeed failed them the most.

History will remember that a murderer has been acquitted by our courts. He will be walking freely, out in the open. A complete threat to everyone around. They say justice delayed is justice denied. However, in Pakistan, a murderer has been set free because of our laws, especially the Qisas and Diyat laws. A pardon was signed but in such cases, power and intimidation lead to such pardons. Jatoi getting away with murder makes us question our laws and judicial system. It seems that these laws not only favour those who are powerful but are used quite frequently in murder cases.

Should the powerful and wealthy be allowed to get away with such crimes? It’s the fault in our laws that mercy to men like Jatoi. Who is next on the list to walk freely: Zahir Jaffer or Shah Nawaz Amir?

As a country, we are still dealing with the horrors of the murder of Noor Mukadam. We haven’t healed as a nation and have witnessed the bone-chilling gruesome murder of Sara Shah Nawaz at the hands of a man who too was raised as a result of the patriarchal norms in the country. In Pakistan, powerful men can get away with anything, even murder, without any repercussions. Our society and justice system have failed the men and women of Pakistan.

Islamabad police books PTI’s Senator Faisal Javed and others on terrorism charges for protesting after Khan’s disqualification

The Islamabad police have registered cases against Pakistan Tehreek-e-Insaf (PTI) leaders Senator Faisal Javed Khan and others on terrorism charges for protesting against Friday’s Election Commission of Pakistan (ECP) verdict which disqualified PTI Chairman Imran Khan.

A First Information Report (FIR) was registered against PTI leaders on Friday on the complaint of Subinspector Inamullah at Islamabad’s I-9 police station.

The FIR said police officers in an official vehicle were posted at Faizabad to maintain the law and order and security situation. It said that around 8pm on Friday, a large PTI rally of around 1,000 to 1,200 people carrying sticks and rods started moving towards Faizabad.

The complaint named PTI leaders Amir Kiani, Wasiq Qayyum Abbasi, Faisal Javed Khan, Raja Rashid Hafeez, Umer Tanveer Butt, Rashid Naseem Abbasi and Raja Majid.

It added that the demonstrators advanced while running over the police contingent with vehicles with the “intent to kill”.

It is pertinent to mention that PTI workers across Pakistan came out of the streets protesting against their party chairman’s disqualification, however later at night, Imran Khan called for an end to the protests.

‘Insaaf ka nizam aik hota hai, mumkin nahi ke Nawaz ke liye dusra nizam hai, Imran ke liye dusra’: Shahid Khaqan Abbasi

Shahid Khaqan Abbasi, the former Prime Minister and Pakistan Muslim League-Nawaz (PML-N) leader talked about the Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan’s disqualification on October 21.

Discussing the topic on Geo News’ programme ‘Aaj Shahzeb Khanzada Kay Sath‘, Abbasi said: “The one who accused others of corruption has been proven corrupt himself. It is a test for the Supreme Court now. Let’s see what it decides “

He said that it is clear that Imran Khan was found involved in corrupt practices. Abbasi was of the view that it is inappropriate to be happy about making false statements and concealing facts while being the prime minister.

During the show, he stressed on the fact that Khan’s Toshakhana case is far more legitimate than Nawaz Sharif’s case on the basis of which the three-times former Prime Minister was disqualified for life.

Recalling his party chief’s disqualification, Khaqan Abbasi said, “Supreme Court (SC) deposed a prime minister and disqualified Sharif for lifetime on minor charges as compared to Khan’s Toshakhana matter.”

When asked about the seeming recent change of heart in the SC about disqualifying a politician for life, the PML-N leader responded: “Insaaf ka nizam aik hota hai, mumkin nahi ke Nawaz ke liye dusra nizam hai, Imran ke liye dusra.” (Justice is the same for all. It is not possible that the justice system is different for Khan and different for Sharig. Law should be the same for all.”

While talking about PTI’s planned long march, he criticised Imran Khan, accusing him of destabilising the country for his own sake.

On October 21, the Election Commission of Pakistan (ECP) in a consensus verdict in the Toshakhana reference, disqualified Imran Khan and ruled that he is no longer a member of the National Assembly. The Election Commission also directed criminal proceedings to be initiated against Imran for misdeclaration.

The ECP ruled that Imran Khan submitted a false affidavit and was involved in corrupt practices under Article 63(1)(p).

‘Qanoon ke saamnay sar jhukay’: PM and others react to IK’s disqualification

The Election Commission of Pakistan (ECP) on Friday disqualified Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan under Article 63(1)(p) of the constitution in the Toshakhana reference.

Article 63 (1)(p) of the Constitution states that an individual is, “for the time being, disqualified from being elected or chosen as a member of the Majlis-e-Shoora (parliament) or of a provincial assembly under any law for the time being in force”.

According to the verdict, criminal proceedings will be initiated against Imran for misdeclaration.

A four-member bench, headed by Chief Election Commissioner (CEC) Sikandar Sultan Raja, unanimously announced the verdict. The PTI chairman is no more a member of the National Assembly.

The commission stated that Imran Khan submitted a false affidavit and was found involved in corrupt practices in the reference.

Following the announcement, Khan’s party leaders and the coalition government parties reacted to this major ruling.

Prime Minister (PM) Shehbaz Sharif said that PTI should refrain from violence and bow its head before the law.

“The Election Commission did justice in the Toshakhana reference. The nation has seen that the post of Prime Minister has been made a source of personal income through corrupt practices. The idol of honesty and trust was shattered,” the premier added.

Pakistan Muslim League-Nawaz (PML-N) Vice President Maryam Nawaz spoke to the media in London. She said, “Khan is Pakistan’s first certified liar with irrefutable evidence of theft.”

She added that after this verdict criminal proceedings should start against Khan and he should be punished for his theft.

Foreign Minister (FM) Bilawal Bhutto-Zardari said that Khan has been caught “red-handed”. In a tweet, he stated: “He who would spread lies about the alleged corruption of his political opponents has been caught red-handed.”

The former planning minister, Asad Umar, made an announcement, saying: “The decision will be challenged in court. The dream of ‘minus Imran Khan’ will never come true.”

Umar’s party mate Fawad Chaudhry asked the people to come out of their houses for their rights.

He called the ECP’s ruling a “slap on the face of 220 million people”.

“Not just anyone cannot disqualify Imran Khan. Only the public can do that,” the PTI leader said.

He alleged that today’s verdict was “written by Nawaz Sharif and signed by his servants”.

Alongside him, PTI leader Shahbaz Gill said the PTI would approach “every forum” against the verdict. “Imran has been disqualified from just one seat, not politics,” he added.

Minister for Climate Change, Senator Sherry Rehman, took to Twitter to say that Imran Khan’s disqualification case is no different as he is not the only one who has been disqualified.

In a series of tweets, she said, “Those who claim to bring a neutral umpire want the umpire to decide in their favour, otherwise the decision will not be accepted.”
